I think in your case your I 140 is no longer in approved state it is in MTR state right? From what I understood in Yates memo is that your I 140 should be approved or good to be approved state to safely invoke AC21. But at this moment your I 140 is not in good to be approved state. So I would recommend extreme caution and consult some really good lawyer who can give you the best advice since AC21 guidelines have laso changed a few weeks back. Make sure you dont make a hasty move without consulting lawyer.

"ADJUSTMENT OF STATUS ON THE BASIS OF EARNED ACCESS TO LEGALIZATION"
Is this not going to help us?

I thought Efiled EADs do not need photos sent. Has anyone received EAD after Efiling without sending photos.

Sorry, If I sounded that way, I understand that nobody is having honeymoon here, but EB-3 2005 is better than EB3-2001 and EB-2 Current is better than EB2-2003. In a situation where Congress in not buzzing from it's stand of 'No New Green Cards' for anybody. We have educated them enough that they are not new Green Cards, rather the truth it they know it all, they know the issue more than most of us do, but it's just they pretend to be ignorant. In this scenario I would ask them for atleast a fair system, if they want to keep everything else unchanged..
Mirage everyone sympathizes with position of EB3 India. Any bill including HR5882 that passes the Congress will eventually help the bottomline in all categories. Right now this bill is in House judiciary committee and has come up for markup and just missed it. This bill has good support in both houses and is the only realistic bill that can provide some relief this year. No body here thinks that country quota is fair. There is no argument. However it is not the time to fight but join hands with ROW to get the bill HR5882 passed. One step at a time. We should continue to raise per country limit, but now is not the right time for it, when HR5882 with a broad based support is on a fast track.

PPP is another way TSC wants to keep people in dark, but I searched web and didnt find anything official except for AILA website which asks you to register to get the details and murthy and couple of other website, but nothing official, also these website has very little information to conclude anything.

Got a soft LUD on my I140 today (140 was approved on Jul 2006).

Jul 2nd AOS filer.
Had some LUD movements after FP's but everything was holding still since 12/18/2007.
It probably means ........ who knows!!!
I also had 2 soft LUDs during March 2008 on my October 2005 approved I-140. But my PD is not current.:confused:

Few things to note:
One should have the right to pursue anywhere's GC and it should not automatically affect anything in process. Applying for canadian GC and doing a landing are two different things. Of course at the time of landing you will need to decide which one u want to stick with for future. So what zCool mentioned , I dont think applying for canadian GC demonstrates an intent to abandon your in-process AOS application,especially with severe retrogression.
I do know of cases where after getting canadian GC and completeting landing , their intentions have been questioned, which is very reasonable. But have not heard of any case where just applying for it is enough to abandon your AOS. If someone is willing to back that claim with experiences please post.
Also regarding the job market, you do need to realize that it is not as big as US market. So getting a nice decent job of your liking is not going to be easy thing. But it is not as bad as posted on some websites. When you make up your mind to move, it would help to look for job in canada while you are present in US as your search is perceived differently.
I agree. There is no way that USCIS can discern intent to abandon (given the well known problems with the US GC process) simply by applying to Canada as a back-up plan. Canada can't discern intent to not land, since it is clear that the applicant simply doesn't have a discernible intent (due to the vagaries of the US system, they simply can't know their intent, since intent is based on circumstances).
Certainly Canada can discern that US residency is "preferred", but this does not imply a lack of an intent to land, as the applicant can only form an intent (one way or the other) once they have the option to land. There is no restriction in applying for permanent residence that disallows having a preference to reside elsewhere.
I'd "prefer" to live on a south pacific island surrounded with dozens of beautiful women attending to my every desire; but somehow I just don't think that's in the cards, so I have no intent to do so at this time. If I were offered this option I'd give it serious consideration though :-)
