Hi beauiful Mind congratulations.... I have a question... Did you do porting with same employer???
I am working with my employer from 2005 to till date. My green card was filed in EB3 cateogory with in 2007 and priority date is March 2005. Before I started working for my currently I have worked for more than 5+ years in India with real experience from companies like IBM. My employer is ready to file my GC in EB2 category. As I hear mixed review for the same that porting between EB3 to EB2 with same employer... I am considering option to change employer but my question is. I have my I-140 approved thru current employer but my I-485 application hasn't been filed. What if my current employer revoke my I-140 can I still use the same priority date.... Please advice/help.

Dear Friends,
Please answer this question urgently. Currently me and my wife are in EAD working here. My wife needs to go back india for her delivery. please let us know what are the implications? Is there a problem bringing baby later to US? what visa they give to baby? What happens if my approval happens during that period(July -2002 EB3)? or do we get another finger printing notice if we can't go?
PLEASE WAITING FOR YOUR REPLY.

Hi Pappu,
Along with the letter, instead of just asking for the raise in limits and recapture, why not also propose the H1 cap based on country, this will help them to clean up the existing system effectively...

I am a July 2007 filer joined new company(1000+ employees) in Jan 2009 & applied for H1 transfer. H1 with old company is valid till January 2010.
Now my H1 transfer is denied. I am 99% sure my company will not file MTR. It looks like it is their corporate policy. Most probably i will not even know the reason why it was denied. (again corporate policy).
I need your valuable suggestion. What are my options here?
1) Can i go back to original company if possible?
2) Can i be able to do an H1 transfer if I find some other company? Will it be approved considering that MTR is not filed for current applicaiton.
3) If I can file for H1 transfer with other company how much time i have to do it.

Thanks Ab, your post make me realize even more how lucky I am. I was really stress about the H1B..so stressed about it that I paid out of pocket the premium processing fee just to find out ASAP and move on with my life.
I know that in some area of the country the demand is higher. In Tennesse the demand is high, so high that 2 pharmacy schools just opens "at the same time" this year..of course once they graduate they will flood the market, but for now it's seventh heaven here for us foreigns. It's also important to target the right company.
-Target pharmcacy won't file for work visa, I had them on my list on interview day, but my chinese friend went and they told her not to bother, they don't do it.
-Walgreen and wal mart will do it but they wanna send you where they want cz of yur status.
-CVS and Rite aid will do it and location are negociable
But I think the bottom line, when you go to pharmacy school here in the us, is to network while in school. Do not wait until interview day to find an employer. That's what I did, I went to interview day knowing that I already had 2 jobs on the table. I would not stress enough to the one dat r still in school in the us, to work on CPT during school, make connection, make people like you and once you graduate they can tell their boss that this one is staying with me in my area.
My CVS people here are earger to please me, to find me a location that I like, why should they care?. after all I am just another H1B to file for, us pharmd or not. That why I think making connection during school is the key.

My apologies for the delayed response, went to DMV office after 5 days and no issues faced.
The secondary validation cleared and did not face any issues this time in getting the renewed license.
My strong recommendation is to wait for the old EAD to expire and then go to DMV with the new valid EAD.
I understand is some cases we are without a license for few days (in my case 6 days) But i dont see any other option.
Except if you go one month in advance and go thru is whole SAVE verification..

If you leave the country, your pending application is deemed abandon. You have already spent money on the H4 application. You need to decide if u want to stay and wait to know the application status or go home and speed up the process.
I was told that Interview in India regarding TVU was same as here what ICE is asking by coming the students home in USA. I heard from my SIL that some of the F1 to H4 conversions in the consulate went well without issues. But again every case is unique...so you need to decide.
If she has valid H4 stamping they can just exit and enter. It is better to re-enter with new I-94 whether you go for stamping or not. It clears lot of questions in later stages.

If rejected due to unavailability of visa numbers, you will not face any issue in future because of that reason
Someone asked me if there was any long term effect on 485 application if it were rejected due to july vb fiasco... other than non-availability of Visa numbers... I mean if its rejected once (and due to the July VB fiasco) does it get undermined in any way?

In your fianc�'s case, make sure you are married before you file 485. You will need to put her name on your 485. You don't have to wait until she completes her HRR.

1) I switched to another company on EAD.
2) I worked for GC sponsoring company for over 2.5 years after filing I-485.
3) My current job title and responsibilities are almost same as earlier one.
Today I got a text message from USCIS with an RFE. I am still waiting for the letter in the mail.
Now:
1) What are all the documentation I need from my new (Current) employer apart from Employment Verification letter (EVL)?
2) Can i continue to work for the current employer while my case is in suspended state?
