Wow..this is definitely a first. Is the employer who sponsored I-140 under investigation? Unless the I-140 is being revoked for fraud, I don't see the connection between the I-140 and the H1B client letter.

I am a bit confused on how you can avoid the mention of EAD. If the individual is the primary applicant in the GC filing, would he/she not need sponsorship if he/she moves to a new employer? Does the employer not have the right to decide whether or not it wants to hire someone who will require sponsorship?
Confusion prevalent because EAD is right at the border line between "Sponsorship" and "Permanent Residency". Theoratically EAD is meant for waiting out till you get Physical GC with flexibility of having any employer in your specific field (Principal Applicant). so if 485 case is straight then no communication or information need to be exchanged to and from USCIS and applicant/employer and thus one can say that it is not sponsorship. It was easy to agree upon this definition yeras back when people used to have Physical GC within 6-12 months of EAD approval. But now it takes minimum 1 year to maximum 5 years ( What I have observed so far...) to have GC from the date of EAD approval. USCIS takes that much long time and punish applicants as to verify whether employer is still interested in pursuing employment.. whether required parameters/credential still possessed by the applicant and in that case if one has changed teh employment then new employer as well ass original employer may have to involve in communication depending upon particular nature of RFE and that is how it can also be called "Sponsorship"... Now many employers do not want to take that pain and hence avoiding EAD holders for the employment..

Hi,
My Labor was denied in 6th year. I have my 7th year extension in couple of months.
My employer doesn't give much details of why my labor was denied. When i insisted them the reason for denial they said that they just got a letter saying that they are already US Citizens available with that skill set. I asked them to send a copy of the denial letter but they say that that letter also has other case numbers which they filed and don't want to reveal them. Is that believable?
I said them to file appeal so that the case would be in pending and i can apply for 7th year extension. They said that its an no objection denial and they cannot appeal the case. Can it be true?
Now i am even not sure if they applied for Labor. I need to get some proof from them. For what document can i ask them for this? What should i do in this situation?

dont get it....
firstly i dont think the memo is due to corporate pressure, quite the opposite, i think.
second, what has the misuse of any visa got to do with employer-employee relationship, which is what is being contested in this lawsuit.
lastly, freedoms/rights are different than priviledges (read immigration). one is always "free" to move out of consulting into F/T (can be painful from time prospective, but still one does have that freedom). This would make this memo non-applicable.
Disclosure : i am working a consultant, and memo get cause an RFE on H1 extension.
and my original point was that this memo or lawsuit or its dismissal, all 3 are not good, as it could lead to begining of the end.
So that only corporates could use the H1Bs and no one else. to give control of H1s to a selected few only. corporates doesn't need to worry about it and I dont think body shopping type companies are even corporates...

First time my mom's visa was rejected after just a couple of simple questions.
2nd time before interview I called senator's office and explained his assitant that my Mom's purpose of visit is tourism and she has enough property and family ties that she won't stay over here. Also I am going to take care of her all financial needs. After our discussion she agreed to give me a letter and send same later to Bombay Consulate explaining all details based on our discussion and requesting officer to do needful. 2nd interviews was pretty simple… couple of question (very simple question) and before even she completes her 2nd anwser officer congratualted her!!!!!!...
How to make sure that US tourist visa gets rejected …. Give following reason to question like “ why do you want to go to USA?”
“Take care of Grandchildren or daughter/daugther-in-law is pregnant”
Babysitting is business in USA and if you say that you are gonna do babysitting in USA … Officer will reject your visa without asking anything else.

It takes only few mins for EAD bcoz it is code 2.
However for 485 it can take longer bcoz it is code 3

Yes...he took only one finger (my right index finger) print. Thats all, signed the electronic signature reader and then took a picture with my glasses off (it that usual?? I dont know).

What is to stop them to refuse all immigration....remember its not a right! make you pack your bags and leave, if they want.

I called USCIS because recently I had changed my address and despite filing an AR11 I did not get a fingerprinting notice at my new residence. They told me that if your case is pending you not only file an AR 11 - which you are required by law and which goes to a separate office; but you are also required to call customer service and inform them about the change of address!! The system is so broken that they openly ask applicants to send the information to each of the silos within USCIS.

I have already written a letter to the investigative services. I sent them a nice polite letter. When I called them, they acknowledged the letter and made an effort to track the documents they never received. In our case, our documents were either lost by the DMV office or never sent. Finally, they gave up and asked us visit DMV office to resubmit documents. Hopefully, it works this time. I'm going to wait until June to see what happens. If nothing happens, then I'll probably write a letter to the commissioner of driver services.

Murthy's website actually had a section called "Benefits of Retrogression" a few weeks ago.
Like, a delay in 485 filing gives more time to the bachelor's to go out to home country and look for a suitable match and get married before filing 485 etc.
Needless to say, whatever such trivial benefits(if that's what you call it) result from retrogression, all those benefits can be available by simply delaying the filing of 485.
However, that's your typical lawyer's view. "Benefits of retrogression". Its like saying "Benefits of Starvation and famines". Although famines cause starvation and shortage of food, the benefit is that no one gains too much weight and those who seek to lose weight can finally succeed since, there isnt any food around. Such benefits is currently available only in famine struck regions where food is really in short supply. There is no obesity problem - A HUGE ADVANTAGE ... LIKE BENEFITS OF RETROGRESSION - for people who are running out of food to eat.

This is POE in Dallas. In Nov'08 on my return flight, I was sitting next to a consultant who went back to India for 2 months after the project was done. We started talking about immigration etc on the plane and she had casually mentioned that she is praying she gets a project because of the October tanking of economy while she was out. She was at a different window and then she started walking behind the IO crying and ran into me. All she said was "client letter"-no time for a conversation. I do not know whatever happened to her, didn't see her come out while I waited for bags and went through customs.
TARP POE problems sound like rumors to me. But they are cracking down on benched consultants.
