I was planning on getting these docs from employer and then telling him abt the new job but unfortunately the new comp did a background check and called my employer. So I had to tell him and now obviously he doesnt want to co-operate. I will try to reason with him again but considering the worst case can we proceed without these?
For 485, employer got us (all his consultants) to write him a letter saying we authorize the attorney's to sign on our behalf, to save time. So unfortunately we dont have copies of 485's.
Now, you gotta stay where you are until 180 days and make sure your current employer does not revoke the 140. You can still move without this documents, but consult with some attorney and find out how to obtain these documents with out your employers knowledge. I read on IV forum, someone quoted some scenario to use FOIA to get a copy of entire 485 file.

I disagree. There are 2 ways immigration status can be changed. 1. You go out and re-enter United States with new I-94. 2. You file a form and ask USCIS to change existing status A to status B (exp from H4 to H1).
This whole idea of H4's status getting changed to AOS the moment s/he starts using EAD is beyond my understanding. My wife is on H4 and she has been using EAD for last 1 year. This year when I applied for her EAD renewal, I put her current status as H4. No issues. I do not believe that by just starting to work on EAD makes any change in the status. She still enjoys the status of H4 with the privilege to work. When H4 with EAD stops working, she still has H4 status. She has got nothing to do to change her status.
EAD my be derived from H1, F1 or H4 status but has different conditions. As she was on H1 and then on EAD, all rules applicable to primary applicants who change from H1 to EAD, will be applicable to her. As Dhundhun stated, she should maintain a correct record of her employment history. Now, I believe she should apply for change of status to H4, and then may apply for EAD again, which is safer. Guys, there are 245 countries worldwide and many choices to choose from the other 244. Many people will just as easily move to Canada others will fit where it suits them best which could be home. We are NSC-CSC-NSC Transfer case. Got Soft LUD on 485 applications for self and husband (self primary). Applied for Husbdan's Electronic EAD renewal. He finished his Finger printing last week at local ASC. Had Soft LUD on his EAD application ame day.
But today we got soft LUD on both our cases. Anybody has seen this trend?

Hi,
There is a chance you may get extension of stay (new I 94), please note that the process is not certain.
I did not get extension approval for my parents.
Let us say for an example, my parents came to US on 01 Jan 2003 with a 10 years visa, up on entry they got 6 months approval to stay, that is till June 30 2003. Please note that this visit was the second visit to US, the first was in 2000 for 6 months.
In March 2003 we decided to request for extension of stay, as per conventional knowledge, we should not make the extension request too much in advance, it is recommended to apply 30 days before you permitted stay ends.
Applied extension on 01 June 2003, the USCIS may take 2 to 3 months to process those application. There is a website where you could monitor the status, every day we used to monitor that and found on 10 Aug 2003 stating that the extension is rejected. On 16 Aug 2003 we got a letter stating that extension is rejected and it is out of status now. Please note that there was no clear indication when the out of status time started, it is a big mess. I do know if an application is pending, it is legal and it is in status.
As per the law, if a visitor is out of status even for a day, the 10 years Visitor Visa is invalid, and could have issues for the visitor's GC process.
Only good part is, in most of the cases they do not invalidate the Visa. I have noticed in many cases the visitors had to apply for a new 10 year visitors visa and that was a big mess too.
The reason why I had to write the long reply is to give our IV members a chance to take an informed decision.
My take is, I would not recommend the extension process to any of my friends.

Employment-based immigrants have been hoping that the SKIL Act be enacted in the form of a rider to the pending Appropriation Bills. However, report indicates that there are allegedly thousands of such "earmarks" attempting to be enacted as a legislation in the form of a rider to the Appropriation bills. People may recall that the Senate refused to pass the Appropriation bills before they got into the Thanksgiving break exactly on the same grounds. There is a prediction that the Lame Duck Congress may not be able to pass any additional Appropriation bills for the stratetic reasons as well as practical reasons. So far, the Lame Duck Congress has failed to move on any key or top priority legislations and is labelled as "Lazy Duck," when it comes to the key legislations. Reportedly Democrats are scheduled to go into a closed-door meetings but information indicates that it is intended for the new Congress strategies rather than the Lame Duck Congress strategies. Another sad story of S. 1932!

Does your USPS receipt has the right zip code in it ? Please check that first..i had a very bad exprience that they punched in the wrong zip code and hence it did not reach for almost 25 days....the bad thing is it took 25 days for every one to figure that it was due to bad zip code.

Please clarify the first message on the thread says, you have arranged a conference call of the members and guest is Bob Casey. Did you not clearly explained on what is going to be talked about, did anyone from the senator's side not explain how this whole thing gonna go?
This conference was pure election campaign they did not allowed anybody to talk Sen casey spoken around 25 minutes and that is about it and he announced about the visit of The President at PA on Oct 30th. that is about it. could not convey the message it was a one way messaging conference.

Mine was transferred from TSC to CSC on June 21, 2007, no updates since then. CSC is not even processing 485 applications. Customer service told me to wait for atleast a year.

I got back from Can on 7/22. I didn't know at the time, but checks were cashed on the 16th (I left on the 19th) and Notice date was apparently the 18th. Had no idea of all this till 2 days ago. So it was in the comp when I met the airport IO and they said nothing about it either.

Actually, none of the bills are really controversial. It is naive to think that the bills which are not getting passed are being stuck because of some politicians' reasonable objection to some sections of it.
It the three bills are not passed it is purely due to political reasons and not due to any logical reasons. In these situations, you can come up with a bill which says "2 + 2 should be 4" and it will still never make it out of the committee!! :)
If there is still hope, we should focus on getting the maximum, and see what happens. Setting the sight low right at the outset is not going to help in any case.

I wanted to go on EAD but my lawyer told me to go for H transfer and apply for AC 21. H transfer does not have good salary compared to EAD. I have 4 offers at this time and my H1B is going to expire on April 17th.
I don't know if the lawyer wants to make money. I have too many backups and my PD is oct 2006 EB3.

I did the same thing in September 2008, when I filed my renewal forms for both EAD and AP. I called the Customer Service Center the next day and informed them. They made a correction online. I also sent them a cover letter stating the mistake I had made in switching the last and first name.
All these corrections were not reflected on the receipts. However the EAD and the AP itself had the correct first and last names. I guess, they use the A number in the system while issuing these renewed documents.
