There is no quick, black-and-white, answer, but you should not rely on any information that tells you that the check isn't good after six months. Here's why: if a check is more than six months old, your bank has two options, either it can refuse to honor the check because of its date, or it can honor the check if it is not aware that you don't want it paid. To tell the bank that you don't want the check paid, you would have to have a stop payment order in effect.
The reason the Uniform Commercial Code (the law that applies to this question) allows banks this choice is that banks process checks with automation that doesn't usually provide the bank with an opportunity to review the date on every check. Usually, banks only see the date if there's another reason to visually review the check -- overdraft, stop payment, a misread of the check data, etc.
The question you didn't ask -- whether you should stop payment on an old outstanding check -- has an equally unsatisfying answer. If you aren't able to prod the payee of the check to negotiate it, you are left to weigh the risk of having the check show up to be paid and the size of the check as compared to the fee you'll have to pay for the stop payment. If the risk of the check showing up is small enough (or the size of the check small enough), you might not want to pay for the stop payment. any one can answer this please?
I know one case where the dependednt was in India when her AOS got approved. She came back on AP without any issues. But the only thing is she was there just for 5 weeks., and this happened last November.
Her husband talked to some lawers to see the possibility of mailing her card to India, but he was told mailing hte card is illegal.

Ask them to kiss your A$$ and move on to the new job. You can use a notarised letter from a colleague in the same company in lieu of an experience letter. There are Tons of ppl who have done that, including myself.

We had seen worst of the GC process:
labor got remanded back to state then send back to DOL again and got approve.
FBI name check stuck for around 2 years,
485 filling during pregnancy,
Fingerprinting notice sent wrong address,
2 RFEs for 485 (one for TB test one to get current employment letter)
and finally retrogression!
I was hopeful when the dates became current that this will be all over soon but logged in today on immigration voice and got the shocking news about visa number for EB are now unavailable. Thought that we were unlucky again.
But then checked the status online on USCIS and there it was following message �
�Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered.
On July 2, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.�
Having gone through the worst, I will always support IV and their effort to get justice to all of you. I pray for all of you to get GCs soon.

How can you invest without a Greencard?
What is the use of investing when interest rates are sooooooooooo low?
You can get better rate in India or if you open an NRI account.
Assuming you are an Indian (which most IVians are I feel), one issue with investing in India is tracking those investments remotely.
I think investments are a must for everyone - irrespective of which card you have. Invest wisely otherwise you'll lose money either due to inflation or bad investments.

I had the same issue last year where I couldn't send the original EAD as my wife was working - I asked the lawyer if we can send a photocopy but seems like that is not an option - we have to send the original EAD and according to our company lawyer it takes around 3-4 months for USCIS to review and take a decision :(. So, we didn't do anything about it.
We did take an info pass and went to the local USCIS office last month but the person said that as your EAD is up for renewal soon, he can't really do anything about it - we should have come as soon as we received it - but he did say that you will receive 2 yrs when you renew it (which is already in process).
The only thing positive that came out of the conversation was that he checked our 485 receipt numbers and said that wait till october, you might not need the EAD :)..........I am EB-3, India, PD is Nov 2005.
I don't know if he was just joking around or if he was serious!!!!

When I filed mine last year (fresh H1) I received a receipt number in 5 days and an approval notice 10 days later.

1. Section245(k) of INA pardons "out of status or worked without authorization for less than 180 days"
2. The out of status days are counted only from "last lawful admittance".

I do not have detail about my RFE. But, I understand my wife & I got an RFE on our 485 applications. I have a concern, I was on F1 visa until 12/31/2003 and moved on to H1B visa on 01/20/2004 (without applying for OPT); so for those 20 days, I am guessing I was so called out of status. Am I correct? Can this cause a problem? I applied for H1B around 10/2003 based a full time job.

m so eagerly waiting 4 my EAD....i have job offer in ma hand :confused:...so dont want to loose jst bcoz EAD.
one more question:
If i gets my EAD in february...i joins my job....and going for vacation in India for 10 days(on 27 th may)...so could you plz suggest me the next steps for EAD in this situation??

I am also in the same boat. I saw mine and my wife's date updated to 08/21/2010. But no status change. Our priority date is March 2005 EB2. Is this soft LUD could be due to RFE? Not sure if they send RFE without updating status?
We have not applied for EAD renewal though.
Get an Infopass and go talk to the I/O. You should get it soon.

Interestingly, the article by Erin lists a number of organizations working on various issues affecting Indians. It may be worthwhile to contact each of those organizations and appraise them of the issues with legal immigration. Some of them may add our agenda to theirs.
Since retrogression (and other legal immigration issues) affects Indians along with people of other countries like China, these organizations pushing an agenda for Indians, will in fact, indirectly help legal immigration IMHO.

It was interesting to hear that there are about 400K EB cases in queue and about 40-45% of them are EB India, and another 20-25% EB China and EB3 Mexico is becoming large too.
Effectively, the only solution that can prevent years long wait for EB immigrants in the above categories is EB relief and visa recapture. So you can understand how helpful visa recapture of 200K or so visas will be for all of us.
Just keep in mind though that if 200K visa numbers are made available...the 400k backlog will not become 400K - 200K. It does not work that way.
Effectively, the only solution that can prevent years long wait for EB immigrants in the above categories is EB relief and visa recapture. So you can understand how helpful visa recapture of 200K or so visas will be for all of us.
Just keep in mind though that if 200K visa numbers are made available...the 400k backlog will not become 400K - 200K. It does not work that way.

My daughter is a High school senior and is applying for colleges in Arizona..U of Arizona, ASU,and NAU.The universities have asked us fill out International application(which requires more appl. fees)and out of state tutions.We have applied for I-485 in July 2007.
Has anyone been in this situation before in Arizona state and after having talked to univ.got instate tutions??We have been in Arizona for past 3 yrs and total of 7yrs in the USA.

Your daughter will be considered as non-resident for tax purposes at any univ in arizona at this point of time...One year from the date of application of 485, most of the universities in arizona will consider the alien as resident for tuition .

It usually takes about 5-7 business days to get the actual RFE.
The usual time to respond to rfe's are about 30-45 calendar days
If you had filled in g28 form(Attorney representation), the RFE's will go to your attorney.
Does anyone know how long it takes to get the copy of RFE after the CRIS Mail?
I received the mail on March 19th and till date have not receivd the RFE.Just worried, if I do not have enough time to respond. Also how many days do they usually give to respond to RFE?
