    hello friends,

    i am in a similiar situation, I have approved I140 and PD is Oct 2004, can i file my I485 now and then file for my wife seperately when she is back in August. any suggestions.

    Yes. They mailed on Feb 22nd and I received on 24th. My friend contacted consulate an year ago for some information on phone and by luck they answered the question.

    I am not sure about other ways to contact other than the example of my friend. Sorry !!!

    I will update this post if I can find any information from my friends.

    A crisis is occurring with EB green cards. Backlogs have resulted for individuals coming from high﷓demand countries, even when the overall cap has not been reached and regardless of the fact that these high﷓demand countries are often the only source of individuals capable of filling high﷓skilled jobs American businesses need. Those caught in the backlog are forced to spend up to seven years waiting, unable to become true stakeholders in our country, putting their lives on hold in the hopes that a green card will eventually become available to them. Not surprisingly, these talented professionals often tire of waiting and leave the U.S. to put their knowledge and skills to use in other countries eager to compete with and surpass the U.S.
    Every day that passes without access to these high﷓skilled workers is a lost opportunity for growth, productivity, and innovation. But this need not be the case.
    By passing legislation that provides EB green card backlog relief, you will be showing your support for enabling the best and brightest from around the globe to contribute their skills and knowledge to the U.S. economy, which is good for American workers, American businesses, and our long﷓term economic health.

    HI Guys,

    I recently received my I-140 approval (premium) and i was recapturing my PD of June 10 2003. The STRANGE thing is that this time i see an "A" number above my name in the Beneficiary column.

    More importantly last time when the I140 approval came along, it said CLEARLY that I could not apply for my 485. This time it says I am eligible and that I should contact the local INS office.

    HAS ANYONE had a similar experience and does the A number mean the "immigrant visa number" by ANY chance??

    There are 3 types of i-140 approval notices. You have A I think the employer gets B and the lawyer C. You definitely have A.
    If you had to go to renew your H 1B the consulate would ask you to bring your "A" copy. Hope this helps

    One of my friends work from his home office as his client is a consulting company and required him to work from home (to support multiple clients of their own and that is their business model).

    He lives in a different state than his H1B employer. The employer filed the LCA for employee's home location. Is that okay? I always wonder how the LCA should work for this kind of situation. Any thoughts?

    Very useful information - the Title and SOC Code exactly mapped with the 'Occupation' field in my labor application.
    I believe for AC21 we need to maintain the same "Title" at least ( and similar Job duties) in the new future employment letter ( if we are sending so) but the Technologies probably could be different.

    I mean a guy doing 'Java J2EE' work could be a 'Computer Systems Analyst' as and if he switches to 'Oracle ERP' Job with 'Computer Systems Analyst' title (Job code same 1051) he/she probably would ne ok.

    On other hand if you are a 'CSA' in 'Java J2EE' and in your new Job offer you are called a 'CSE' (Computer Software Engineer) and you are still working in 'Java J2EE' field you might be in trouble because that's different Job Code 1031.

    These things are ridiculous/weird but that's how the system is designed and we have to live with it unless rule changes. I believe this is 1 point in the "Admin Fix" request to White House.

    As far as I know, you cannot extend your H1 beyond six years unless you filed for I-485 Adjustment of status or have a labor pending 1 year and an I-140 filed before your six years expires.

    Not entirely true. You don't have to file I-485 to extend H1 beyond 6 years. You either have to have labor certification application filed more than 365 days before your sixth year OR have I-140 approved.

    In the OP's case I doubt if he can get I-140 approved before December 2010 if he starts the process in March. However, if he has time spent outside the US, he may be able to recapture those times and extend his H1 beyond 6 years using time outside the US. Thereafter he may have his I-140 approved and then ask for three year H1 extension based on I-140 approval.

    I have seen many such paranoid posts (pardon me using this word, but it is apt) . It turns many viewers and subscribers away. Post the same matter in a gentle way and kindle up your viewers.

    Labor Substitution is ending. There are competent officers to study and grant applied labor substitutions. Leave it to them.

    Lou Dobbs is an abrasive and foul mouth, who feigns fairness in treating a subject of his broadcast, but he is undermining American Competitiveness (and he may be having subliminal messages, one being English/White superiority in human thought and actions)

    In my view, let's not beat a dying horse. There are far more simple and easy things, as outlined in the 'What are we fighting for?' to ask justice for.

    Can you imagine when your dreams are coming true, your life's hard work is shaping up, say your son is 18 and your GC is in process. He is in university here in US. Within 3 years if you don't get GC, he crosses 21 and his GC is delayed and sidelined. It is issues like these that we must fight for. This may not be a common case, but a very valid alleviation to fight for.

    This is the answer to What to do?

    We should campaign for & lobby for this easy, non-controversial bill HR.5921.

    First we have to force the House Immig Sub Committee and then Judiciary Full Committee to complete the Mark up of this Bill, which will make the bill to be debated on the floor of the house.

    Second: After the mark up is over, we need to campaign for proper support in the house to get this passed.

    Before all these: We need to know what the IV CORE has to say & What are the future plans!


    Is there any update from IV core? Any new action item that we should be working on to get some relief this year?

    Troll Alert.
    So we had 30 day ad period and 30 day quite period. But I received a mail from HR saying that they received 40 applications after the quite period was over and they are going to analyze the applications.

    It looks like they did not do any analysis during the quite period.

    May be some gurus can respond if this is normal or differs from case to case and doesn't matter.
