Folks,
My apologies - I am new to this forum and this topic might be repetitive.
My PD is July 2003 and my 485 application reached Nebraska Processing Center on July 02.
My check is not yet en cashed and obviously I am yet to receive a receipt number or EAD.
1) Are there others in my situation (application reached on July 02 to Nebraska) who have their checks cleared?
2) Am I in the minority - one of the few whose application reached on July 02 but the case hasn't moved?

Folks,
I see many many approvals and which is really good....my concern was for those cases which got shuttled around and tossed among centers. My I-140 was approved in TSC and I-485 submitted in TSC but was sent to CSC for data entry and re-sent back to TSC...So I have a WAC receipt no...i know WAC stands for Wacky too and literally so....
I read in one of the threads that EAC folks are getting fingerprint notices post approval too. I have an infopass apt tomorrow in Mass. I need to know should I ask about biometrics data upload or not....I received online case approval but my wife didn't her case is still showing as Case transfered to the center that has jurisdiction over your case...since last one and half years...I had got RFE last year but not her....I hope her case didn't get sidelined or forgotten...it is quite important that she also gets the approval....she had opened an SR on Friday....and we have an infopass appt t'row...
Is it possible that the reason I didn't get CPO or welcome email but just an approval email is becoz of the biometrics problem with transfer cases...anyone on the same boat?
If you guys think anything particular to ask plz let me know....it is quite a drive and I don't want to waste it....

The regulation states that if USCIS requests a visa number for a "approvable" petition, they must use that up (approve the petition) within 7 days of recieving the visa number or return it back to DOS.
In this case they are obviously using the visa number beyond the 7 day deadline.
This is a clear violation again.
There are lots of thing the admin is trying to cover up, because just working over 1 weekend is not going to improve their efficieny to make 60K cases approvable overnight.

Thanks for replying guys, yeah I am not sure wether my privious employer has revoked my I140 or not, I just wanted to know what should be my next step. I have still not got the the RFE paper should I wait or call USCIS to know what is RFE. Please any help at this time is appricated, as I am losing sleep.
My only advice would be to hire a good attorney who can tackle this RFE, you have waited so long and almost on the verge of crossing over, don't take any chances.
It is clear from your first post that your approved I-140 is revoked by petitioning employer however it should not be an issue since you are on EAD and utilized AC21.
Usually the RFE takes about 5-8 working days to reach either you or your attorney(if you had filled in G28 form - the right to represent), contact USCIS if the above time has passed.

Well, contact the congressman. You can't really predict on that.
I called USCIS almost everyday and one evening I was talking to level 2 folks and explained about the case and informed them that I have sent the details to Congreeman. Somehow they have transferrred it to the next level where they have confirmed all the details. As I was represented by an attorney, IO wanted to talk to the attorney and I could not get hold of the attorney as it was late in the evening but attorney called them the following day.
Thanks for the info. By calling USCIS everyday would it not upset them and create more delay. Also they say you should call after 30 days of filling the SR and taking to them.

i have read somewhere in this forum that the new EAD fee structure is a one time EAD fee and everytime u renew it, there is no fee associated?? I must have been dreaming then..
The one time 485 fee around $1000 + dollars is applicable only for all 485 applications filed after August 16 (even though the fee starts from Jl30) because of Jul VB problems. The one time fee is valid only if you file your 485 after that date and you dont have to pay on your yearly renewals. If you apply now and file EAD later you still ahve to pay 325 according to new fee and renew for the same amount every year until you need them.

Company A sponsored my GC. During labour i went to company B worked for them till now. Went to India and got my GC while i was there. Cameback to the states with green card ( Company B H1B expired ). Currently no project with either Company A or B.
I have told my intention to the Company A to work for them. They are saying, its been a month and they have to inform immigration that they couldnt fulful the I-140 committment. They are saying its just a procedure.

That means CIS would deny one out of every 2 application... :eek:
I wonder how they came up with this 50% denial rate....
Does this mean they've already scanned through these pending applications figuring out if an application is missing initial documents? I find it tough to believe....

I think there K Visa - Fianc� Visa to come to US. Not sure how it works.
The K visa is for US citizens who marry a foriegner. They can bring their fiancee on the K visa and once they are here they get a GC\Citizenship.

Over the year i have seen increasingly disheartening posts from people from being abused by their employer to being let go at a critical moment of their GC process where they are left with very little options. The reasons for people seeking jobs within the IV community are many but most of them seem to center around difficulties in H1-B sposorship, GCs, longevity of process, hardships etc. I know that if i was ever in this situation that it would be great if i could use the community's help to get back on my feet if i needed it.
I thought about an idea to create a free Jobs and referral portal to help people in their hour of need. Here are my thoughts & assumptions going in:
1. members of the IV community probably fall under these categories:
a) empowered to hire directly (manager or executive)
b) in a an influencing capacity (reccommend or work with hiring mgr)
c) refer but cannot influence - are aware of job opportunities within their environment that may be difficult to locate in a portal like Dice.
2. members of IV generally work for H1-B and GC friendly companies.
3. Members of IV will be able to give better insight and job prospect opportunities from their enviroment than any job site as they witness the requirement, opportunity, political env, etc first hand to be able to reccommend.
Essentially i want to create a portal where we can match IV job seekers with Job opportunities based on our our hierarchy of influence. we can also think about prioritzing the need based on situation:
1. Lost job & need sponsorship asap
2. Need to be free from terrible employer
3. Just looking for better opportunities with GC friendly companies
4. etc
I am a non-technical person (IT) so I am not even sure on what kind of portal this would be. I am right now looking for feedback from all to know whether this is something that everyone would be interested in, and if so, whether people would be able to contribute some time towards development (at least the techys amongst us).
Any ideas, suggestions and opinions (good or bad) are welcome!

Sen. Jeff Sessions (R-Ala.) will take over the ranking member position on the Senate Judiciary Committee after striking a deal with his more senior colleagues over the weekend, sources confirm to The Hill.
Sessions and Sen. Chuck Grassley (R-Iowa) reached the deal that will allow the Alabama Republican to take over for Sen. Arlen Specter (D-Pa.), whose departure from the GOP last week left the committee without a ranking member.
Under terms of the deal, Sessions will serve as ranking member until the 112th Congress, when he will take over the ranking member post on the Senate Budget Committee. Current Budget Committee ranking member Judd Gregg (R-N.H.) is retiring at the end of the 111th Congress.
Grassley, the top Republican on the Finance Committee, will then become ranking member on the Judiciary Committee.
Last week, Grassley had enlisted the help of Sen. Orrin Hatch (R-Utah) in positioning himself for the top slot on the committee. Under the deal floated then, Hatch would have taken over Judiciary for the remainder of the 111th, with Grassley taking the helm once his tenure on Finance expired.
The seven Republicans who remain on the Judiciary Committee after Specter's departure will meet to vote on Sessions's ascension early this week. Once they do, the decision goes to the full Republican Conference, which usually ratifies decisions the committee makes. Sources could not recall a ranking member vote made by a committee that was not, in the end, ratified by the full conference.
The move is likely to please conservative organizations around Washington who are gearing up for a fight over the eventual nominee to replace retiring Supreme Court Justice David Souter. The departure of Specter, who had long been one of the leading GOP voices on judicial appointees, had robbed the Republican conference of an obvious spokesman.
Conservative groups, who have already held conference calls to begin organizing a response to President Obama's eventual nominee, were wary of putting Grassley atop the Judiciary Committee if a fight were to break out. The organizations viewed Sessions as the better spokesman, and more likely to lead the Republican charge in questioning the nominee.
Though Republicans are likely to face a filibuster-proof Democratic majority when the nominee heads to the Senate, conservative opposition groups said they would push senators to ask tough questions, in line with those Chief Justice John Roberts and Associate Justice Samuel Alito faced when they underwent confirmation hearings.
Leading conservative legal strategists have admitted they have little chance of pursuing a filibuster � even facing only a slim deficit, Democrats were unable to block either Roberts or Alito � though that has not stopped them from gathering intelligence on leading contenders for the nomination.
Already, those groups have spread around opposition research on top contenders like Appeals Court Judge Sonia Sotomayor and Yale Law School Dean Harold Koh.

Hi ,
My wife and I are currently on H1 visas working for different companies. She is supposed to travel to India this sunday(Jun 17th) for a 7 week trip where she had a consulate appointment for stamping etc and is scheduled to return on Aug 5th 2007.
We are in a dilemma from yesterday when we came to know that I485 has become current. We are looking at two options but am not getting any lawyers to confirm as they are all at the immigration conference till Monday and I need an immediate solution. The two options are
1) She cancels her trip and we file and wait for the EAD etc before both of us go. However it is 80% essential she goes now.
2) She goes on Sunday, and I get all my 485 docs/health certificates in order and file and file in July. When she comes back in Aug I can add her on to my 485. Is this feasible and will this affect my 485 application?
3) SHe travels a week later and we can complete all documentation within a week? Is this feasible?
Any and all responses are appreciated and any other option we can consider.
One attorney got back to me saying if she adds on to my 485 in aug, there might be problems if it is not current and your application may also be pulled out of the quese. Is this right.
