AC21 was enacted to protect you from this very situation.
The only effect on you will be that you might get an RFE before adjudication and all you have to do at that point is an employment letter in the same or similar job description.

There is a big rumor going around about sending back the people with valid visas at the port of entry. Can the IO just send the people saying,there aren't enough jobs? I definitely think it is not that simple. But would like to know what are the guide lines given to them. Like what could be the standards that should be met. How this is different for the people entering with H1b status and using AP. What are the options if somebody is denied the entry but is genuine. Please through your opinions as someone could be more prepared while they travel.

Yes, once your I-140 is approved with your current employer, you can transfer to a new employer and get a 3 yr H1 extension. You can also port your priority date from your current labor certification application when you are ready to file 140 with the new employer (only if your 140 from old employer is not revoked/withdrawn)...

Yes, that is normal. By default, all controls are displayed in the style of their OS theme such as Vista's Aero or XP's Luna and Royale. You can create custom controls that override this behavior, and while you can do that directly writing XAML, it is much easier using a visual editor like Expression Blend.
The namespaces you mention are used to primarily to integrate WinForms controls into a WPF application. Either way, you will still see OS-specific versions of the controls unless you create your own or modify an existing control.

It is just unfare to push this through our throats,I am sure there are thousands of American Companies which do this, I am sure Accenture,IBM do this, there are 15 million illegal immigrants who are not getting arrested.As I said before it has some thing to do with republicans vs Democrats fight.We are caught up in the cross fire.Grassley should be mad that Obama has won in Iowa.Iowa Democratic Party had some Indian women in prominent position.There are millions of Americans who dont pay taxes at all why nobody is arresting them?To me it looks like it is politically motivated.

My nephew and niece got visit visa for another 10 years last month. Their 10 year visa was expired last year. They are now 18 and 16 years of age. They got their visa stamped in Kuwait. They did come here and left within 1 month for all their 5 visits. So the VO convince their intention (just for visit). So age is not problem, VO is not convinced most young guys (Indian) intentions. They give visit visa for young guys from Europe and other countries.
The VO said all the required documents are good. He was asked for how long he wants to be in US.(answer was 1 month)
VO said he can not issue visa as he is too young. "We are not issuing visa for people of your age."

This is the fist time I am hearing that a lawyer is refusing to provide the information of 140 to sponsering employer. This is ridiculous. I-140 is employer's property and lawyer is working for employer. I guess, there is something else that you might not aware of. You should try to have a conf call between u , lawyer and employer and find out where is the issue.
I am sure, the employer has some issues with the previous legal, but the employer is not willing to share or talk about. Whenever I bring up the point of contacting the previous legal, they don't seem to like it.

Thanks for the replies. I was suggested with an alternative option as below.
"Transfer H1 to F1 , get CPT and work for my same employer till labor and 140 gets approved. Once the approval is done, renew the H1 and transfer back to H1 from F1."
So please let me know if this is valid status transition.

I look at this like differently, we all in building with people from each country and cateogy packed in one room. Our friends at DOS/CIS get to pick 140k random people from these room (based on 7% country quota and EB category). If they keep SK current that room is always empty and they break the 7% rule. If they follow the 7% rule the olds people in the building (india/china) get a chance to get out.
I agree. The crab analogy does not apply here. The country quota's are supposedly to stop some countries hogging most of visa numbers - but when it has the opposite effect it clearly shows how this quota system and over-flowing methods they are using is so useless.
In my ten years of greencard hassles I have seen many people getting their greencards in a fraction of that time - this after having three grad degrees and 10+ years experience - and if I feel a bit bad about the kid who just got promoted from intern to regular position and got his green card in eight straight months - it does not show my crab mentality but rahter failed country quota policies.

I am analyzing a few scenarios to plan ahead and had a question on status during an MTR filing and an AAO appeal.
In the form I-290B looks like there are several options but mainly looks like
a) Appeal at AAO
b) Motion to reopen
From all the web research I see that the AAO appeal process takes 8-14 months for I-485.
If on 1 Dec 2009 the pending EB I-485 gets denied. Then an appeal is filed on 2Dec2009 which gets logged in say on 4Dec2009. What is the status of the alien from 4 Dec2009 till the appeal decision is made in 8 to 14 months ? is it counted as unlawful? Also does it depend on whether appeal gets denied or approved?
In this situation assume:

b) alien is laid off and no similar job has been found.
c) alien ports to self employment but has no clients as its a new business at the time of I-485 denial. Uses the yates memo and self employment as basis for appeal.

As part of Team IV I took ownership of organizing IV professional networking events and had some time carved out this weekend to put some thoughts together on how to do this. We already have a linkedin group for Immigration Voice and I have become a member of this already. I will be glad to work with you on this.
I can help too. I can set aside some hours for this project and can develop or do anything else required. I have some spare hosting space with lots of facilities like data base access and IV job site can use this.

My wife's online status shows an RFE was issued on her EAD renewal. The only possible problem we consider is that there may have been a mistake in the printing of the name. She did not keep a copy of the form, so right now we are unawaare of why the rfe was issued.
IF it is the problem of the name, what documents should we be sending? Passport and birth certificates are in the maiden name. any help is appreciated.
