Dear Friends,
Please answer this question urgently. Currently me and my wife are in EAD working here. My wife needs to go back india for her delivery. please let us know what are the implications? Is there a problem bringing baby later to US? what visa they give to baby? What happens if my approval happens during that period(July -2002 EB3)? or do we get another finger printing notice if we can't go?

To the best of my knowledge there is nothing called H4 transfer. The only thing that matters is validity. If her H4 is valid then she is fine. If her H4 is expiring you should apply for extension based on your H1B.

Sorry amul, h4 transfer does exist, and every time you do a h1 transfer it is mandatory to do a h4 transfer too.

While I am in full praise of your knowledge in the immigration process and you are very good at interpreting the stuff and help people - you do contribute towards a lot of spreading negative energy. We have seen you discouraging people a lot during the rally when we were mobilizing people for the rally.
Whatever IV is doing is for people like you and me - if you have valid concerns do please let people know about what your concerns are.

No I don't mind...and let me tell you if one is sincere there's nothing dumb in any question.
I almost don't want to answer your question because there is risk here assuming you are sincere, you know it or not...you believe it or not there is a danger of you trying to base your opinions on my experience. Someone else's experience should never be our base...it can be an aid though but we got to be smart enough to know whether we are forming a base or using it as an aid.
If you are not sincere but want to judge me I don't want add to your burden...isn't there enough stuff in the society to judge already in the name of religion or something else?
Now coming back to your question I didn't look for what I found( at least consciously).
When I said in my earlier post that I found what I should I was not giving credit to these vidoes/Nithyanada alone .I'm ALSO giving credit to these videos/Nithyananda.That's why I said try if these videos help you in your chosen path.
I found some keys to open the inner space. I found out that I already have some keys in my hand placed there( in my hands) by my SELF. Only I kept throwing them away.But these videos helped me realize that I should hold onto these.That's why I understand Intellectual path as well as I understand religious path.
Concisely I found inner Truth.I've not arrived yet. So I don't want to share anything yet though my post keeps running long.
But I'll tell you everyone should know what their style is. In spiritual path to some people a spiritual Master holds appeal.Some can lead themselves. Let me tell you again drop them if you find no appeal in them.But don't drop them because someone criticized them or out of laziness.
Lot of abstract stuff in a way but when it is inner space answer to 'what did you find?' will not be like 'I found this castle/chocolate house/gold mine :) (if you so want you can create them though)

What does Congress, Senate and House mean?
The Congress, which is divided into two chambers, a Senate and a House of Representatives.
The Senate is composed of two members from each state as provided by the Constitution. Its current membership is 100.
Membership in the House is based on each state's population, and its size is therefore not specified in the Constitution. Its current membership is fixed by statute at 435.

Hi All,
My green card appliation was approved in Aug 2010, but i left my company (which sponsered my GC) in June 2010 after working 7 years, after that i never filed AC21.
Should i get any kind of letter from my GC sponsered company? will this be a problem for citizenship process? please let me know what to do.

This 30 day rule is bunch of bull. There is no written official evidence of it. Desi, show me this on any "Official" web site. Flat wrong statement.
You status is H1-B since Oct 2008. You had 30 days to start working (from Oct 1st). You are accumulating out-of-status days.

i dont understand why would the percentage of AOS applications go down when there is an increase of AOS filing year over year.

I have heard from a couple of folks that they have met some senior senetors like Bob Dole and have influnced INS to speed up their case of GC processing. Is this true ? .
If this is true is there a way to stop the influence by senetors so that these everyone gets a fair chance of getting their GC.

Unless USCIS approves 40K visas (or whatever was the number in the ombudsman's report) between June 12th and July 12th, I don't see how they are going to retrogress the dates in the middle of the month. Please remember that the visa number is consumed when the application is approved, not when the application is submitted.

In Feb 2011 you filed taxes for calendar year 2010 - in which you were single. So you can not re-file as 'Married filing jointly' for 2010 tax return. For 2011 - yes you will be able to file 'Married Filing Jointly'

But I thought LC is an ad for a future position. As long as the employee is qualified and willing to accept the job for the advertised wages at the advertised location when he gets his GC, there should be no issues. For that matter, there are many folks on this forum who have their LC filed in one state but are currently working in a different state without refiling LC. How is this any different from the promotion case ?
Now I fully recognize many employers will choose to exploit their employees and deny them any raise or promotion knowing that they pretty much own the employee until he gets his GC. But is taking promotions against immigration laws in theory ?
I know for sure nothing in immigration law even requires an EB beneficiary to be working in the US on an H1-B with the sponsoring company until he gets his GC - although that is the only feasible practise given the long delays in processing a GC.

At the time of 485 uscis will ask for Employment verification letter at that time you have to provide them as it describe in you labour + i140.
Enjoy life and stop worry about GC which most of the indian will never gets.
I think you are still better then illegal who gets green card before us.

I think AC21 is applied not just to AOS but also to H1. I will be consulting murthy lawyers regarding this as I need to get an answer for this.
Yes, AC21 is applied to safeguard H1 journey beyod 6yr as long as you have an approved/pending 140 and Labor.
Once I-140 is cancelled the above won't work.

Personaly I think spirituality and religion are VERY VERY important parts of life, and often are downplayed, or shirked around because of the unpleseantness of a few individuals. Some of us (I've a feeling our reverend included) are probebly very soft spoken in opinion, and open to inturpretations from various factions.. at least as far as discussion goes.
Being an Agnostic, Realist, Budhist, Communist I do know what it's like to have to walk away from certain conversations.
Personaly I think spirituality and religion are VERY VERY important parts of life, and often are downplayed, or shirked around because of the unpleseantness of a few individuals. Some of us (I've a feeling our reverend included) are probebly very soft spoken in opinion, and open to inturpretations from various factions.. at least as far as discussion goes.
