Isn't it the job of the lawyer to review the resumes submitted and build a case to say why you are the best fit for this position? I am sure that's what the DOLis looking for as well - i.e. that the companies are following the protocol of advertising the position correctly and reviewing the resumes of candidates who apply. I think it will be a red flag if you don't show any resumes at this time esp. when the unemployment is so high as opposed to showing other resumes submitted.

I had looked in to this about 6 months ago when I was up for an extension. Research showed certain pieces of the fees could be paid by the employee and still be legit. My employer ended up picking up the entire tab so did not have to pay anything. On a side note I did have a visit from uscis sleuths after the renewal and they did ask me who paid for the petition myself or the employer. just my two cents!

will really appreciate some help with this... i have so far heard only instances of people coming back in with no problems with the same visa but a lot of information available online seems to indicate that visa is void and one cannot come back on the same visa.

Say if they table CIR these bills will be attached to the bill to act as poison pills
and eventually Tech industry will lobby against the CIR and it will come crashing down.

Yes, you can. You can mail the documents to any consulate. But If it is more than one year of expiration, then you have to go in person to get the renewed passport.

I'm in the similar situation, but in my case my wife and son are already in India and they were supposed to return on july 28th. Is it possible to add them later to my I-485 after they returned? or, pre-pone their reurn schedule a week ahead will solve the issue, please advise!

My wife and I are currently on H1 visas working for different companies. She is supposed to travel to India this sunday(Jun 17th) for a 7 week trip where she had a consulate appointment for stamping etc and is scheduled to return on Aug 5th 2007.
We are in a dilemma from yesterday when we came to know that I485 has become current. We are looking at two options but am not getting any lawyers to confirm as they are all at the immigration conference till Monday and I need an immediate solution. The two options are
1) She cancels her trip and we file and wait for the EAD etc before both of us go. However it is 80% essential she goes now.
2) She goes on Sunday, and I get all my 485 docs/health certificates in order and file and file in July. When she comes back in Aug I can add her on to my 485. Is this feasible and will this affect my 485 application?
3) SHe travels a week later and we can complete all documentation within a week? Is this feasible?
Any and all responses are appreciated and any other option we can consider.
One attorney got back to me saying if she adds on to my 485 in aug, there might be problems if it is not current and your application may also be pulled out of the quese. Is this right.

I am stressed out due to the fact that earlier when i got my EAD, we got it very late as we were the unlucky few. Most of the applicants got theirs by September/October and ours got delayed for some reason and we had to book InfoPass to find out why we were not getting the EAD and finally it came in Jan. I am concerned that now when i have applied if it does not come on time, i will get so screwed and will have to leave the job and specially when the economy is not doing good finding job is very stressful.
Based on what you all advised, How do i get the TEMP ead and how early can i get it. Can i go to USCIS local office now and get one as a backup?
When, How and where did you apply. You can't just go and get temp EAD. If you have applied before 120 days your application will be sent back. Have you got Receipt notice for your EAD renewal.
If it is 90 days after you applied and is still pending then you can go and try to get the temp EAD. There are some threads where guys have mentioned some FAX to expedite EAD request etc.. check that.

Hi,
The EB1 has a section for international executives and managers. Does a manager need to necessarily have direct reports ? For example a project manager managing a large project on-site might not have direct reports but might be managing a $10MM project. I have a friend who has the offer to come here on L1 as a project Manager. He is wondering if he can take advantage of EB1 as a multinational manager. He is coming in on managerial capacity.
Does anyone have any information on that ?

For the benefit of others:
I spoke to USCIS this morning. The lady asked me to file the AR-11 again since I used I-94 number and not 'A' number. The lady also mentioned that she cannot confirm an address change for me via the phone system since she does not access to any personal information. According to her I will receive a notice in the mail
Also my lawyer said he has no idea what will happen to the old AR-11 forms I filled with errors. Hopefully nothing!!!!!
He also mentioned that I should not file AR-11 for AP(I131) since the AP notice is supposed to go to him. Also don't make the mistake I did and file AR-11 for I140.....

"DO NOT mail photos or copies of identification unless requested to do so by USCIS."
Is this RFE is due to that you didn't sent photos part of supporting documents.

wow that's even worse, waiting from Feb 08!!. I was hoping that we might have some response when we go next time. if you are waiting since feb we might as well give up.
I requested the officer in the DMV office to call us if they get response from USICS and he was nice enough and agreed to, we were so fed up and thinking not to go back to DMV until he calls us hope fully he gets response before he retires (Officer looked to be aged person).
I am thinking that we should go to a different state and get the driving license.

I think those dates are wrong bcos my 140 was transffered to TSC and my application date is Jan 30th, 2006. If we look at the processing dates since last 2 updates, it has stayed at Jan 19th, 2006, though my 140 was approved way back in April. The processing date has never moved beyond Jan 19th, still my 140 was approved!!!!!
So, I guess those dates are not what is being actually processed, especially for 140.

I realized this morning that my passport got expired on 4/4/2007. Can I renew it at any Indian embassy in U.S after the expiration date?
I have valid 1-94. Any advice or help would be appreciated.

Go to Any Indian Consulate website and they will give you a checklist of documents required if your passport has already expired.
