HI Guys,
I recently received my I-140 approval (premium) and i was recapturing my PD of June 10 2003. The STRANGE thing is that this time i see an "A" number above my name in the Beneficiary column.
More importantly last time when the I140 approval came along, it said CLEARLY that I could not apply for my 485. This time it says I am eligible and that I should contact the local INS office.
HAS ANYONE had a similar experience and does the A number mean the "immigrant visa number" by ANY chance??
Hello
There are 3 types of i-140 approval notices. You have A I think the employer gets B and the lawyer C. You definitely have A.
If you had to go to renew your H 1B the consulate would ask you to bring your "A" copy. Hope this helps
thank you

I applied H1b for my wife when she is in India, now she came to usa on H4, She has I94 of H4 and she cant apply for SSN using H4 194. If she needs to apply for SSN she needs to go back to India / Outside the USA and come back on H1b Stamping where she get I-94 for H1b Status. But instead of doing that now she got her EAD, can she do the any of the below so that the EAD will not come into play and where she can still use her H1b and as you all Using EAD until 485 gets approve is not suggestable....Thank You..
I have few question that needs clarification from ...
1) If i apply for SSN using EAD does Her EAD becomes Active immidiately and she should be only on EAD status?
or
2) can she still use her h1b as and start working on h1b as she gets her SSN using EAD?
3) If the Primary Applicant 485 is Rejecte in case . Will the Spouse card also gets rejected automatically?
Thanks for the replies...
Since your wife entered using H4 her status is H4 and will stay that till a COS is approved or she gets it stamped abroad and enters using H1. So though she can work using EAD she cannot use H1 just like that.
She can get SSN using EAD but it will not let her use H1 for work.
If the primary is rejected than the derivative loses all ancillary benefits as well.

Please see my response:
Gurus,
Please help with these questions on EAD/AP/H1. I have heard so many different versions that I am confused.
We are planning to travel to India in June/July and both of us have valid H1 extension (I-797) until Dec 2009. H1 visa stamp in PP expired two years ago.
We also have EAD, AP, all valid until next april.
a) is it necessary to go in for a visa stamping at the US consulate ?
Depends on your wish.
b) if we use AP to re-enter what will happen to our H1 status ?
You can continue to work on h1 if the employer is the same as the one who sponsored the H1.
c) if we use AP to re-enter should we necessarily use EAD to revalidate I-9 ?
Not necessary.
d) Assuming we use the AP to re-enter and get a "parolee" I-94 until Apr 2010, what will happen to our H1 approval which expires in Dec 2009 ?
You need to extend your H1 which will put you back in H1 status from parolee status or you can use EAD if you dont want to extend H1.
e) if we get a new H1 stamp and use the H1 to re-enter what will happen to our AP, EAD and AOS filing ?
Nothing.
f) what will happen if priority dates becomes current (I know, I know, that sounds silly, but I still gotta ask) when we are out of the country ?
AP can take care of this.
f) transit visa problems with either AP or H1 at London, Frankfurt, Dubai ?
I'm sure Asia pacific route will not have any issues.
Thanks.

I think we are resident aliens not non-reseident aliens.
Q: I know some people wont get a stimulus payment. How do I know if Im one of them?
A: You wont get a stimulus payment in 2008, if any of the following apply to you:
-You dont file a 2007 tax return.
-Your net income tax liability is zero and your qualifying income is less than $3,000. To determine your qualifying income, add together your wages, net self-employment income, nontaxable combat pay, Social Security benefits, certain Railroad Retirement benefits and certain veterans payments.
-You can be claimed as a dependent on someone elses return. For example, this would include a child or student who can be claimed on a parents return.
-You do not have a valid Social Security Number.
-You are a nonresident alien.
-You file Form 1040NR or Form 1040NR-EZ, Form 1040PR or Form 1040SS for 2007.
So, aren't we all "NON REsident Aleins". Correct me if I am wrong.
Thanks

Already joined the state chapter.
Don't get me wrong. It's been observed that you always end up saying "Join the state chapter". Not sure if people really go with it anymore with the same old comment over and over again among the posts. Ofcourse if they want to join they will in anycase. Reminding them n number of times for each and every post may not fetch much I guess. Is this repeated comment fetching or loosing the impiortance. Personally I think, atleast it is making to loose importance.
It would be much nicer to have suggestions and discussions to the question than advise to join.
Anyways take it easy.

hang on.... I am looking for my magic 8 ball. :D
Honestly no one knows for sure. With the new congress with democrats in power, the chances have certainly increased that something may happen in 2007. However, it's next to impossible to predict any timeframe with any more precision than that.
I set myself a deadline of March 2007 for any reform to be passed so I can atleast decide to go Home for good, folks do you think SKIL will get passed before that ?

Folks,
I see many many approvals and which is really good....my concern was for those cases which got shuttled around and tossed among centers. My I-140 was approved in TSC and I-485 submitted in TSC but was sent to CSC for data entry and re-sent back to TSC...So I have a WAC receipt no...i know WAC stands for Wacky too and literally so....
I read in one of the threads that EAC folks are getting fingerprint notices post approval too. I have an infopass apt tomorrow in Mass. I need to know should I ask about biometrics data upload or not....I received online case approval but my wife didn't her case is still showing as Case transfered to the center that has jurisdiction over your case...since last one and half years...I had got RFE last year but not her....I hope her case didn't get sidelined or forgotten...it is quite important that she also gets the approval....she had opened an SR on Friday....and we have an infopass appt t'row...
Is it possible that the reason I didn't get CPO or welcome email but just an approval email is becoz of the biometrics problem with transfer cases...anyone on the same boat?
If you guys think anything particular to ask plz let me know....it is quite a drive and I don't want to waste it....
Regards,
SoP
I am not a WAC receipt no but am an EAC no where the case sent to VSC from TSC and back to TSC. I was told by IO that these cases have problems in Biometrics upload however Biometric upload is not required for approval but required before they order card. They approved my case on 9/4 however TSC tell me that cards will be ordered when biometrics are uploaded. Per IO in local office i do not need another FP as FP was renewed electronically but Bio needs upload. I am following up at TSC and via my congressman to get the cards. Call TSC, take INMFOPASS write to Congressman as these transfer cases are generally put at the back. Mine was picked up because of INFOPASS as the IO at my infopass was so nice that she called TSC and requested to have my case reviewed. She also wrote an email to them and within couple of hours of her writing it was approved.

Hi Experts,
My wife applied for her Advanced Parole and the following shows up on her status online. What are the typical RFEs that folks have been getting? The USCIS rec'd the supporting documents and this appeared the next day. She has her own approved I-140 so she is not a dependent.
------------------------------------------------------------------------------------------------
We mailed a notice requesting additional evidence or information in this case I131 APPLICATION FOR USCIS TRAVEL DOCUMENT. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail.
------------------------------------------------------------------------------------------------
Please advise.
Thanks.

Since most members on this forum seem to be Indians, I have a question. How multicultural are Indian cities like Mumbai? Why don't you have millions of immigrants from totally different cultures slamming into your country every year? Here's a clue to the poster above, maybe we'd like our cities to look like American ones. And the sad fact is that London has ceased to be a British city anymore; it is one, like many here in the US, where the British people have fled to smaller communities to live in something that looks like Britian to them.

Andy,
Some of the answers to your questions should also be in your job offer.
For example the notice period, benefits, medical, gc and ofcourse the pay.
These should be a good indicator of what you are get into
Hi I got a job offer from TCS America. Not a great company to work with i guess but given the job market i want to be little conservative.
In the past i heard some bad things about TCS practices and benefits (medical and so). I am not sure if they stay the same or anything has changed. I also heard that they ask for 3 months notice if you choose to leave.
Could please any of you familiar with TCS and their benefits please pass on your comments. I am specially interested to know how professional they are and how their medical insurance work. (I am told the medical insurance is very bad that it doesn't cover much .. is that true?)
Appreciate your help in advance. It is important for me to know these details before i choose this career move.

From what I remember, it took about 7-10 days in my case, and it was sent to the law firm retained by my previous employer (although an AP + EAD and AC21 were filed much earlier by new employer along with G-28s for each).
I would call them and create a service request TODAY (considering long weekend) or do whatever it takes. The time to respond isn't really adequate if you consider these delays - the petitioner/applicant should be provided at least 60-90 days to respond before issuing a NOID or denial.

I am not yet in his shoes, but I have been issued a RFE on my 485 too, and it has been 11 days (and counting) since the date of issue and have not received the letter yet.

New information about NSC-CSC-NSC transfer cases. The infopass IO showed me her monitor where my Priority date has all zeros. She guessed this is why NSC is not picking up my case for approval. My wife's also the same. And sad part is that, they can not rectify this. Only a NSC IO can rectify this if you open a SR. And I know how easy that is - just last week a NSC IO barked at me. Only God can help me now!

Department of Homeland Security, that is what all the Lawyers are insisting, don't ask me why.
LOL, why? Because it's written in I-485 form - "The check or money order should be made payable to the Department of Homeland Security", Page 5. I would suggest reading these forms carefully before filling them up.
