i didn't want to get to the specifics. But since you mentioned it let me explain.
1. H1B guys once left US and live in India (or their home country), are NOT required to file US taxes (after the current tax year). But US citizens are required to file US taxes wherever they live permanently.
I infact wanted to stress the words "wherever he live" in my last post (maybe I was not clear).
2. Tax Credits don't give you enough benefits. Especially if you are moving to a country of lesser tax. To make it simple, lets say one rich guy moves to Bermuda for good, but keeps his US citizenship. He pays 0 tax on his income & capital gains in Bermuda (taxhaven), but ends up paying most of US taxes (even after filing as a NON resident). Now on the other hand if he threw his US citizenship away before moving to Bermuda. He pays no taxes in US and in Bermuda for his income and capital gains.
So lets not generalize. For most of us it doesn't matter, since we plan to stay in US permanently. But if one genuinely plan to stay outside of US forever, you might want to look into things like this.
Again tax is just one of many items. I don't want to write an essay. if you have some specific questions on this topic PM me and I will point you to right direction.
This is true for all green card holders and most H-1B visa status holders as well. As long as one is resident US person for tax purposes, he/she has to report worldwide income.

That is the same exact problem i faced for both the primary and the dependent application. Good you found it! those are the required fields.

1. Pick the service center where your I-485 is currently. That is a tricky question.. right now most I-485 applications are either in Nebraska or Texas.. I am not sure.. You will have to probe this further.

But I remember reading somewhere that you get 3 year H1 Extension only if your I-140 is approved and I-485 is not applied. Once you apply for I-485, you cannot get 3 year H1 extension instead you get only 1 year of H1 Extension.

Amendments can be filed at any time (upto three years I believe is the statutory limit). If you owe IRS money, they will impose interest on that money. If you are getting money from IRS, you do not get any additional interest.

I understand one can stay out of job while on AOS (with i140 + 485) and it is advised to keep a job offer of same or similar in hand but my question is.. Is it by law that USCIS contacts or requests for employment verification letter [when approving I485] or just a possibility?
Couple of members above sounded like they were certain that USCIS "will" ask for employment verification letter.. To my best knowledge this is more like a lottery..
Please correct me if I'm wrong..

In my opinion, legal immigrants already in this country waiting for their greencards from years can be strong key players in improving the economy. Most of them are waiting to buy homes , open businesses and spread their wings but are in limbo because they don�t have green card. Without green card, if they loose their jobs on H1-B and don�t find a new one immediately, they are forced to leave US immediately losing all the investment they have done. Lot of legal immigrants are willing to buy homes if given an immediate greencard in return to insure their investments. With a whole new group of people investing in homes, opening new businesses, you can imagine how much that will contribute to US economy at this time.
All these people are legal and are waiting from decades because their applications are stuck in backlogs. They are already working so if given a green card, they are not taking anyone�s job and infact will create more jobs for American People once they launch their businesses.

2.Your I-485 can be denied for any reason.
so it's must that if you leave current job, do maintain good relationship with GC sponsor employer, you still need their support to have a smooth sail.

Staying at the sponsored company till GC approval may be best (from GC point of view) - but if we have to change, AC21 is a good thing. But I heard some stories which makes me nervous - one such story is someone's 485 was rejected without NOID (notice of intention to deny) and he came to know only when EAD renewal was rejected. The reason given was that underlying I140 was revoked - even though his 485 was pending 180+ days. I read this story somewhere, not sure what happened. Maybe an appeal might have corrected it but its still pain. AC21 can never really replace the peace of mind of having real GC. Also the provision of working in same/similar job and its interpretation is vague and may not workout well for many.

so... I waited for four years before my employer started the permanent residency process. Don't ask me what they were doing before that. They were starting the process for four years. Well they started and the PERM is pending and it will be pending for how long is up in the air.
After reading this forum I understand people have been waiting 3-4 years for labor certification. 2 more years are needed to get the actual green card and 5 more years to get the citizenship. So, I will be hitting 50 by the time I will be US citizen??? OMG!
As an H1B holder of 'extraordinary abilities', with two masters digrees.. I have been serving my term for a salary of a security guard. Can it get worse than that? Ha ha ha

I received call from my attorneys office advising me to refile the application as they didn't see the checks got en cashed. They were telling this to all EB3(India) applicants, because they suspecting from October they will Retrogress pretty bad. They want to ensure we don't miss this window, and not able to refile the applications in case if USCIS come and say they never received my application.
Did anyone received this kind of advice from lawyers?

I had two LUD's (04/09 and 04/10) on approved I140 (May 3rd 2006). This is due to the system upgrades as mentioned in many threads in different websites.. nothing more..my PD is EB2-Nov 2006..

My situation is in some ways similar to the previous writer. My 6 years on H-1B will expire August 2010. My employer will petition for new H-1B starting August 2011 (and may petition for Labor Certification when I return again) The job description for the H-1B is the same. Are H-1B's usually/often approved in cases like this where the job is the same? Is it helpful (or not) to have had an H-1B before? Any guidelines on this? Anyone out there who has done this?
