    Hi all,

    Greetings! I need to visit Canada for a week begining 7/27/07. My lawyer will be mailing my I-485 mostly this monday. He recommonds not to travel out side US until we get receipt notice. My Canada trip is very important. AS per my knowledge we will not get new I-94 as long as we are traveling for less than 30 days to Canada. Any thoughts about the impact of traveling to Canada before we get receipt notice for I-485?

    As long as you have applied for your extension before the expiry of your I-94 , you are good to go. My H1 extension was filed 10 days before the expiry and it got approved in ~3-4 months ( non premium off course ) and at that time our immigration folks had informed me that , once an H1B extension is applied , you can legally work in US for 240 days ( that's the max time USCIS gives itself to adjudicate the application ).

    Is it true that one can continue working (once H1B extension is filed)? Even after the current H1B expires?

    Interesting...this is the first I heard of this, but it could be true.

    If so, lsanthu, you have even less to worry about - you can continue working!!!

    You do not need to worry, as you are covered under CORBA, Its US law, and even if it is a desi company you need not worry, call your HR after you leave current job, ask for the your plan administrators phone number, and for the neccessary forms, fill in and send it. He cannot deny it. But you need to enroll within 60 days or so.

    I just realised how important it is to have a group insurance. I am moving to a company who do not have group insurance. And the only option is to use COBRA or buy individual plan.

    And for individual plan "Materinity Benefits" does not get effective until 18 months or 24 months depending on the insurance.

    So the only option left for me right now is take COBRA from old employer.

    Any experience people in same boat, please educate or help me

    Hi my EAD is expiring on Jan 12 and i have applied for a renewal 120 days in advance. I am worried that if incase my EAD card does not arrive on time, i may require to terminate my employment. My EAD status still shows as Pending.
    I also read that USCIS does not do Interim EAD any more due to law changes. Is there any one who has faced this situation and knows what to do?
    Do i have an option that i may be allowed to keep the current job and wait till the EAd arrives.
    Please advise the best course of action so that i can keep my job and not get it terminated.

    How can you apply if it is expiring on Jan 12. It is not 120 days yet rt. How did you file, eFile or Paper based, i applied in TSC on July 18th and got the approval yesterday. So you should be fine,do not worry.

    I had been there @ HYD Consulate for my VISA stamping in May 2010. It all went very cool. They didn't even asked any documents. It just took hardly a minute to complete the interview. The only problem that I have noticed is that because of the loud noises around, you need to concentrate much on what PO is asking. It is very hard to hear. I witnessed this problem more with parents. They were not able to hear it clearly and PO rejected the VISAs.

    When did you receive your passport back? After how many days?
    Did you also get 221g request, like I am seeing on a lot of cases?

    I only have 2 weeks of leave and I am hesitant to be stuck over there more than that time. People are saying the that 221g form is being issued with "Not in PIMS" as the information given for them and they are waiting for more than 2 weeks.

    The only way out that I can see would be a self petition. Self petitions are complicated and very fact specific. It is not possible in a forum such as this to proprly advise you how, or even whether to file such a petition.

    Once your I-485 is denied, you will no longer be in legal status.

    I have slightly different situation. I have entered into US in Mar 2007 on H1B status at which time my I94 was stamped H1-B and dated until Sep, 09.

    During July 2007 Fiasco, I was able to apply 485 and is pending. However, I never used EAD or left the country so far. When my I 94 expires in Sep, 09 should I exit and enter back using AP or since my AOS is pending, I can continue to stay after I 94 expiry.

    Any words of advice will be appreciated..

    When your I-94 expires in Sep 09 for H1-B visa, are you planning to extend your H1-B? if so, you would get new I-94

    If you do not plan to extend H1-B then

    1) You do not need to leave the country just to get a new I-94. Your status remains legal while AOS is pending even though I-94 may have expired.

    2) If you need to leave the country surrender your old I-94 at the airport before departing. When you arrive you should get a 1 year validity I-94 based on your AP.

    Like I had mentioned- Since this is all speculation and NO ONE really knows (USCIS included) the total backlogs they have- The resource allocation suffers due to this lac of information which eventually leads to slow processing- which in turn leads to increase in backlogs- which adds to more backlogs since more people apply.

    In short in the realistic scenario somewhere along the line they will have to start looking into making changes. Even though now India and China are retrogressed (ROW too) sooner or later other countries are going to start coming to a point where they are also going to have to face lines- not necessarily due to lac of availability of visa's for them but due to resource allocation- then what do they do?

    lets all get to work and become active in our state chapters to meet lawmakers. If your state chapter is not active, activate it yourself. If nobody is helping you, do it alone. Others will join you when they see someone working. Just sitting back and speculating on bulletins will not help this cause. If you are relying on visa bulletins to save you for the next several months, then you will be disappointed.

    You need answers and solutions from a good lawyer to represent you and if necessary to accompany you on a meeting/conf call with your employer.

    You can apply for a tourist visa so that you can stay in some sort of legal status. But you cannot work while on a tourist visa. Then you have 6 months to sort things out and see if something works out.

    I know someone who did this that is why I am suggesting. But please consult your lawyer prior to this.

    The cons of this are that you are burning through your savings to support yourself and might have to face disappointment towards the end of the tourist visa.

    I am one of the late new comers who came to know about the IV and will certainly try to come to the rally and have spent countless going thru the forum from anonymous member?

    What strikes me me that the the highly Skilled immigrant community has not differentiated them from the rest of the population very well.As any first marketing MBA can tell you the your Unique Selling Point is the differentiating factor.

    Highly skilled immigrants sound good for USCIS and legal terminalogy but for general public must know that you are the doctors who take care of them and their children, Computer Engineers who keep the system up and running , the pharmacist , the medical researchers

    My point is show your educational achivements for the public to understand that you are highly skilled if you have Bachelors Degree ,Masters degree , PhD , Pharma , MD then show it.You earned then it fact flaunt it :D

    My case was in Nebraska and was transferred to National Benefit Center on lee Missoury the only answer i got is, it was transferred to speed up your process but i know and i have read that missouri only is a hub to local field offices, my lawyers does not know the answer some say it will be transferred to local office for an interview, My God Miami is so full and bad treatment from officer, i do not even want to think about it. If anyone has any input i will appreciate that.

    My profile is what it is. I am on H1B and my EB has not started yet because my employer has told me that he "wants to see my performance first for 1 year". Unfortunately, It is not a fraud, " "7 year experience" at entry level fake resume making" IT consultant. It is a Fortune 500 company.

    So what you are saying is that I can change jobs based on a H1 tranfer also, but that would need them to sponsor for H1.

    However, if I change saying I am authorized to work and don't need any sponsorship, I am basically voiding the existing H1-B by moving to this new job.

    EAD, I guess then does not come into play in either of the above mentioned scenarios for me.

    Is this right..??

    As far as i know, you should not transfer your h-1 before 180 days of filing 485 and an approved 140. this is what i have understood from different posts. I am not saying i am 100% right, but better talk to an attorney. You can use EAD to work 2 jobs, while you are working for ur current employer who has filed ur 485.
