    Please clarify the first message on the thread says, you have arranged a conference call of the members and guest is Bob Casey. Did you not clearly explained on what is going to be talked about, did anyone from the senator's side not explain how this whole thing gonna go?

    This conference was pure election campaign they did not allowed anybody to talk Sen casey spoken around 25 minutes and that is about it and he announced about the visit of The President at PA on Oct 30th. that is about it. could not convey the message it was a one way messaging conference.

    Did you get your denial papers, there is a date mentioned in the denial papers, you will have to respond within that date to appeal your case with supporting documents if the case is denied in ERROR (they give reasons in denial letter). If you don't respond the case is denied forever.

    Also remember one thing you can't have two PERM applications open for the same company, same position and ofcourse same person. I had to withdraw my appeal to file a new PERM. some people here seem to be lucky to get perm in 2 months but for me it always took around 10 to 11 months. I lost 10 months in appeal and 2 months for withdrawal. so better decide what you would like to do.

    Other option, which i am not sure is legal (or valid) would be to appeal the case and when the case status changes to pending file for H1b extension. In the mean time look if some consulting company can file PERM for you externally, if you get that PERM approved you can transfer your H1b... I mean it is easier for us to advice.. and i totally understand what you must be going through.. I was just thinking what options are open.

    As suggested i would ask my employer to start the new PERM process immediately as well as file the request for the reconsideration to DOL/Balca for denied perm (I believe which makes the PERM status to pending and borrow some time) and at same time to file for H1B extension for 7th year based on submission request of reconsider to DOL/BALCA.

    I am 100 % sure my case has screwed up because negligence or ??.

    It is a really a very horrible experience.

    Do you know if the denied perm file date can be considered..in case if my employer filed the new perm in Oct 2010..

    Thanks in advance for urgent advice for my bro..

    His employer of 5 people if filing a H1 and the lawyer document says some fees can be paid by the beneficiary. I never heard that a beneficiary must pay. Please advise on the 2 points below..Do you guys think this is OK. Other fees are listed as to be paid by employer.

    You can transfer but then you cannot port your old PD.For porting of PD you will need your 140 approval.

    Here to understand it correctly, steps are:

    1. Get I140 approval
    2. Extend the H1B visa, you should get 3 years extn.
    Is there any case, where someone did not get 3 years of extn?

    3. Transfer the H1, just a copy of H1 approval needed, and I-140 approval notice is not required. The H1 with new company should be for 3 years, as your original approval was for 3 years. No matter how many years you have been on H1 prior to this approval.

    4. Start the GC process with the new employer.

    5. When filing I140, try to port PD, but requires the earlier I-140 approval notice.
    Whould the LIN# which was approved and online status email be sufficient?

    Hi,

    I received my permanent green card based on marriage to US citizen, valid for 10 years last month. Now, I am planning to travel to India after close to 9 years, but I am extremely concerned about returning point of entry issues and I wanted to see what would the community suggest.

    I came to the US in Fall of 2002 on a student visa. Around aug - 06, I went out of status. Right around then I met my future wife who is an american citizen, we moved in dec of 06 and got married in Jun 07. Due to financial hardship, we couldnt apply for my AOS/GC up untill late Oct last year. [Oct - 2010]. We hired a lawyer and every thing went pretty smoothly and fast.

    I had my EAD approved within 45 days and I got my GC interview after a month. We [me, wife, lawyer] went to the meeting and everything went great. Our interviewing officer just took 20 mins to question us and we received my Permanent GC [not conditional] in the mail shortly there after.

    Now I am planning a visit back home for one week, because I couldn't get more days off.

    I am just worried about my return step to US at the port of entry. I have been reading and I learnt that I just have to present my country passport and physical green card to the officer who will then scan and ask questions.

    What kind of questions can I expect from the officer?

    Will he be asking me questions about my past as in when was the last time I came to US?

    Why I was illegal/out of status of close to 4 years and questions about our marraige etc?

    When applying for GC we collected lot of documents to provide to the USCIS that our marriage was in good faith such as joint bank accounts, pictures, leases etc. Should I take all those documents with me when flying?

    Will taking a certified copy of my marraige certificate beneficial along with the supporting documents?

    It feels like another "meeting" with USCIS where I have to show proof but I am really concerned that I dont get denied at the port of entry.

    Also, after I got my EAD, I moved to another state to work on a contract position for couple of months. I consider my actual address as the address I applied my GC which is in another state, since this is just temporary job. I already mentioned this to the officer at my interview and he noted my current location/job title etc during that time....should I do something about it?

    Sorry about such a long list of questions. Its just that I havent travelled out of country in such as long time and I dont know what issues I could face and what I need to carry with me so that I can be allowed back into the country upon return?

    Out of status for that long probably carries a 10 year entry ban.

    You will just be relying on the POE Officer's oversight as your hopes of getting in. Other than that, anyone who looks through the history deeply has a good chance of catching the issue.

    I don't think being a GC holder makes any difference, as the out-of-status was accrued before GC.

    I am not a lawyer, so don't take my words without verifying with lawyers.

    My understanding is the same, I don't think this is anything new - again we don't know on what basis do they select cases to be transfered to the CSC or VSC though.


    Whenever I checked it was always like that, atleast for the last 6 months! What is new now? All the centers showed a processing date even before.

    I think they are ignoring Bi-Specialization system for the Jul-Aug07 485 filers.

    It expressly mentions Canada and Mexico also and says even travel to these countries mean abandoning the app.

    Is it justified that so many years are being wasted?
    Is this not abuse of human rights?
    Is this not let down of expectations set by USCICS to its customers?

    Is there no legal recourse possible? Is there any precedent to this? Is it possible to rally funds to start a class action lawsuit against USCIS?

    My visa is valid until 2010 Dec and my employer has posted job posting for my green card process 60 days back. The last I heard from them was that they received 40 resume against my job posting and they were looking at these before going ahead and filing for my labor. So given this situation can someone share the possible outcomes?

    - Will they not file for my labor if they find matching resume against my job posting?
    - Any suggestions to get some ways to avoid these resume on any criteria?
    - If at all this ad posting falls, when can they post an ad again. I am short on time so would like to know if they can post another ad immediately?

    If you have a poll on this forum, for the majority, the preference #1 will be GC. Death of Osama won't be a first priority. So there is nothing wroing in talking about GC in every thread.

    Get hold of a top immigration attorney right away and schedule a consult right away.

    You need answers and solutions from a good lawyer to represent you and if necessary to accompany you on a meeting/conf call with your employer.

    Hello, I am an Indian working in US for 2 years, I am on H1B visa now. before that I did my Masters in US. I did not applied for Green card yet. Actually I am going to marry a Russian girl in 6 months time. I want to know if I can apply for Green card under her name after our marriage. (can I do that?) Because I heard that getting Green cards for Indians takes lot of time. If I apply for Green card after she comes to US, then do we both get green card soon? I am not familiar with the green card rules yet. Any advice will be appreciated. Thanks a lot. :)

    If u r serious to get the GC, don't even imagine to apply urself as Indian...u will almost never going to get it unless u r ok to wait for 10-15 years. Its no brainer to understand that if u apply through ur wife, u will not only get the GC but will get sooner.
