If your h1 has I-94 attached and that I-94 number is same as your h4 I-94 number then you are on H1-b status from Oct 1st. Each day you are without pay adds to your illegal stay.
If you h1 does not have any I-94 then you have to get stamped to come to h1 status.
Reality:
No one cares about your status till you apply for GC and as long as you donot go for H1B visa, you have no problem. I would wait long enough till I find a job, if not you always have the alternative to go outside and comeback on H4 with no problems. My friend was in the same situation and she ended up getting job after she came back on H4, guess what she did, start working on H1B and she got a GC too. Immigration laws r so complicated sometimes its better for us guys with status problems. Good Luck in your job hunt

What you said is correct. You have to re-submit aplication along with the original apporved EAD.
My lawyer screwed up the photographs in my wife application and sent some body else :) He is submitting the EAD and AP applications again .

BTW, when I was calling USCIS they were telling me the same - "if your checks wont' be cashed in 60 days, just refile again". It seems to be no problem for USCIS. My checks were finally cashed though.

Do not get excited and think that they are going to approve your case. You all have PD's which is far from the dates which are current. You will not get GC so relax and do not worry about soft lud.They might be pre-adj your case now.
I saw my wife's 485 get a SOFT LUD and was happy to see activity. Her PD is EB2 (India) December 2005. Now reading the posts here it looks like it was the EAD application she has that might have initiated it. I hope someone looks at her 485 and she gets greened instead of approving the EAD.
We opened an SR for her and we got response on Friday as application under review. We did a second level IO and that person told us that her application was preadjucated and this was 6th of August. Nothing has happend since then.

But for illegals Z visa(Even without GC) is much better than status quo. That will give some life to them and also it will send a message that when anyone breaks law path to citizenship is impossible. But this is also impossible as it is fundamental shift in immigration policy.

The 3 year extension is based on approved 140. Once the 140 is revoked, it is not valid. All the documents liked to 140 should also become invalid. This is purely my opinion for which I would like to get a concrete answer. If this is true, then switching is advisable if and only the previous employer with whom 140 is approved guarantees not to revoke the 140.
Also once the 140 is revoked the PD is not transferrable technically. But this is not mentioned clearly anywhere in law it seems. Some attorneys do use the approved/ revoked 140 documents to capture the PD and some attorneys do not do it. If an attorney does it and if you are able to keep the PD you are lucky.
Again if the employer revokes the 140 and substiutes the labor for another person and gets 140 approved, then this employee will also be entitled to this PD. If you join the new employer and and somehow use this PD, then two people will be using the same PD. For some reason if you get into conflict, then you will be one who needs to forego the PD.
Again all are my views.

Even if your 7th year extension is not applied or not approved from the company that applied your labor, you can apply for H-1B transfer along with H-1B 7th year extension with the new company giving evidence that your Labor indeed was pending for more than 365 days. You do not need apply and wait until you get 7th year extension with your current employer in order to join a new employer. This way you are making INS rich by giving two fees' to get the H-1B approval for the same period.
7th,8th...year extensions are allowed even with the new employer based on the evidence that your labor or I-140 is pending for more than 365 days before your 6 years H-1B date is reached.
3 year extensions:
Once I-140 is approved you can get three year extensions provided you are subjected to retrogression, ie you cannot apply for I-485 because of retrogression or even though your I-485 is applied, you cannot get approval because your PD is not current. In this situation you can get 3 year extensions with the company through which your I-140 is approved and also from a new company along with H-1B transfer you can request 3 year extension showing the approved I-140 from old company and showing the proof that you are indeed subjected retrogression.
PD portability:
Once the I-140 is approved the alien owns the Priority Date and this date is inter transferable between EB applications (1,2 and 3). Alien owns the PD even if the I-140 is revoked by employer. The only case this PD is not owned by alien is when USCIS revokes the I-140 because it is fraudulent.

What happened to all the donors this month? Under 15% donated so for in August.. In July there was a mad rush for all to get a DONOR status due to a RED HEADLINE and every body thought the green card is hidden there. Come August and all the DONORS are not to be seen anywhere.
I was a regular donor and was changed to Sr. Member as did not sign in for monthly contributions. Did many signed in for monthly contributions ONLY for ONE month?????
I think IV need to change it’s policy of donation on Issue Based instead of monthly contributions. I am and will be available to contribute for Issue Based instead of Monthly contributions and just to get a DONOR STATUSr.
Any thoughts as to how can we improve our donations??

Yes, when my neighbor who came with a NIIT certificate in 2006 and got 485 approval the first week of August 2008 with a labor substitution, I did feel "fake" "cut the line" and "injustice" words boil inside me. But they didn't matter. When wifey ridicules your MBA from an elite school here, it does not matter. You attain a Buddha like stature.
Life is never fair. Just keep on doing your part and things will fall into place...sooner or later. Mostly later for some of us unfortunates because of these examination rooms, ultrasounds or complete physicals.

You are already benefited by AOS 485. How can you shift now. I know, there is a Form 8xxx. something, which would cancel 485, and provide CP. But knowing the level of efficiency and proximity, it is NO BRAINER to adapt that route.
Also, if Ron's Pessimism should hold good, NO ONE in the immgn. community is good to go. Dont worry tooo much, Look at the pace, you got July 07, Fiasco results. I donot think, the error cases are even 1% of total filing. Though, they initially messed around, people were benefited with that.
Again see the flow of EAD Renewals... Good and encouraging. Dont swing around, and stay tuned.. You are fine to go.. Trust me.. Have confidence in the system, it will deliver. :) Your good friend's advice.

From what I could understand, there is no mention of EB1 and EB2 at all. It generally covers all canidates who have obtained a Graduate degree in STEM from an American University. So it should benefit EB3 applicants who have a MS in STEM from an US varsity.
Even if there is no direct benefit, taking masters folks out of the quota will cause spillover numbers to come into EB-3.
