Is it a good time to go to India for stamping ? I mean already the F1 to H4 petition is in pending status.
Or I need to wait untill the petition has been approved and then go to India for stamp.

2)USCIS sent us letter to apply again with new fee $340/-
3)I have applied my spouse EAD on Dec 12 and USCIS has already encashed cheque.
4)Today we got a letter saying USCIS found the lost EAD and they will mail the card soon.
5)We called USCIS for refund the money I have paid for replacement card. They said USCIS policy not to return fees.
Hard earned money sucked by USCIS@#$$%
I wish they issue multi year EAD !!

Here is a situation. Me and my wife have been permanent residents for the last 5 years and apply for citizenship. I was the primary applicant when our Green Cards were processed.
Our daughter who is born in the US is citizen by birth. My wife applies for Naturalized citizenship and I do not. Once she gets her citizenship and decide to go back to my home country (entire family). Here are couple of questions that I would like to ask:
1. What will be my status after I go back to my home country.
2. What will be the status of my wife?
3. Let us say I lose the permanent residency status, can I in the future become a naturalized citizen based upon my wife's status.
Please advise.

If your wife naturalizes and you do not, when you return to your home country, she will always be able to return whenever she wants with her US passport. US citizenship is a status she will retain for the rest of her life. You, on the other hand, could have a more difficult time. If you stay outside the US for an extended period, you could be deemed to have abandoned your green card status. And then you might need to start the green card application process all over again and lose any credit for residency you have toward naturalizing. Your daughter (if she is over 21) or your wife would be able to re-file for your green card and you probably would get it back, but this is certainly a cumbersome and time consuming process.
I presume you are concerned about losing your home country citizenship which is legitimate, though I don't pretend to be an expert on foreign immigration laws and you should consult with a lawyer in your home country about this. You also should consult tax counsel to make sure that you are not making a decision that will create problems in that regard.

I like the idea of continuing the Ad. Willing to contribute for that. I suggest IV should come up with Fund raising drives for things such as Ads. This will keep us in the news. I am confident that with the Rally's success, we will be able to meet the funding drive targets.
I think people would be willing to pay for more of these ads! It is important that we do this before or during the time that the defense bill is put on the table. If we start a funding drive now, we can make it!

tell me onething.. how did you come to US.. have had you ever been selected by a reputed company?
I am sure you paid all the expenses +more $$$ to this desi company for them to fake your resume and get over here. And after coming slipping through the cracks you managed in to get some project.
As I have never seen anybody who is genuinely experienced making so many compromises for coming to US. Guys like you are the ones are defaming the whole community.
I always hear a lot of all these people who are working as highly skilled slave, willing to do anything to come here, and I used to think were these people are, I think I finally got one.

The A-number can be on the I-485 receipt notice.
I am filing the Ar-11 online
It asks me for the A number. Should I put in the number on the I-94 or should I put in the number for each petition. It is supposed to be a 9 digit number. The petition numbers all begin with LIN0 followed by 9 digits.
Which number should I put it?

I mean, if say some of us are affected by this but AILA has enough representation, does everyone who was eligible to apply in July become a part of the lawsuit? Now I do not want to be blunt and say that you copied pasted it from that search result into the forum. You should have atlease make a mention of the source or pasted a link as a courtesy.
Now you may ask "so what?" but you can ask that "so?" for any thing and everything posted on this forum to argue on anything and everything. I will leave it there. Peace.

HI Folks,
One of my friend told that my name is very popular in IV forums, and thought of checking how good/bad is my name here.
I'm able to read the forum which was in my name, but I couldn't post a reply as it is closed. So I just started a new thread (of course it took 3 hrs to find and understand this forums, coz I'm not a memebre of any forums)
Some one told that I scrwed their application....I don't think so..coz the stamps are all auto programmed and no body can do anything with that, If it happend to you..then you guys are responsable for this...thinking how?
Yes it is computer programmed. So the s/w might have some bugs...now I have to blame u guys.
I wish you all goodluck with your INS applications.

vikramy, do you know what the RFE is about ? Medical Exams? Are you the main applicant? usually the main applicant gets things first. But you know, this is USCIS expect the unexpected. However you only have 30 days to respond to a RFE so make sure immigration gets it. and think positive, you'll get your green card!

Hi, my husband and I had our interview today at 2pm located in San Jose. Everybody was called for their interview except us and we were wondering why we had to wait for an hour and 25 minutes. Only then we found out, the immigration officer who picked up our appointment letter forgot about us. :mad: When we finally got in touch with someone, we got called in at 3:25 by an old lady immigration officer. She was cold, unfriendly, had a very serious face, and did not make eye contact at all. She did not make things easy for us and there was tension everywhere.
My husband and I have been together for almost 7 years now, but we've only been married for 5 months. I am the petitioner and my husband is the beneficiary. We don't live together because of school and work complications. But we do have evidence to show our marriage is bona fide. Starting with airline itineraries visiting each other going back from 2004 to present, joint checkings/savings account, joint auto insurance, joint credit cards, joint phone account, email love letters and online chat messages from 2003 to present, receipts from motels where we stayed whenever we visited each other, and receipts from places where we ate together. Also, we turned in my tax returns, 2005, 2006, and 2007 and since I have already filed for my 2008, I have included that as part of the supporting documents. We also turned in my pay stubs for the month of February and March, along with an employment verification letter from my employer. Even though we have turned all of these documents to support our marriage is real, the immigration officer gave us the face as if we're going to get denied anyway. Then as she was going through the supporting documents we submitted with the application I-485, she noticed the seal on my husband's court disposition letter was missing. They lost the seal and told us we have to go back to court and get another one because she was thinking we tampered with it. Oh my god, in my mind, I wanted to lecture her to tell their clerks to be careful when filing important documents. They lost the seal to the court disposition letter! :mad: Then she saw her colleague and asked for his opinion and said to him, 'we have a problem'. He started asking us questions like how we met, how old we were, why we're not living together. After we answered, he said 'thats a tough one' and then he left the room. Then, our immigration officer stood up and said she's late for her doctor's appointment. My husband and I were so confused and shocked by all this. It was as if she didn't give a crap about us just because we don't live together even though we have tons of evidence to back up our marriage. It was the worst feeling in the world and felt like our life was taken out of us. :(
So now, we were given a piece of paper stating we have to turn in another one of my husband's court disposition letter with the seal included. It was their fault in the first place for losing it. Not only did our immigration officer made us wait for an 1 and 25 minutes, but she forgot about our appointment too. She never even apologized. She was not a nice old lady. Sorry to know about your bad interview experience. If they call you again for an interview, I would advise to take your attorney along with you. You will be amazed to see how the interviewers' behavior or attitude changes when she/he sees a attorney supporting you...Hire a good attorney just for this purpose if need be, but do take one with you..Wish you the best..

Thank You all, for sharing your expertise. Looks like postponing the trip would be ideal if I can, but I can't given the importance of my trip. I'll be going. To me below is the criteria, used for my own analysis.
1. I am on H1 visa and will be coming back on the same H1 visa.
2. I am physically present in US at the time of filing (physical delivery of I-485 application), will keep record of Fedex delivery.
3. Based on the volume of filing that is taking place, I don't think USCIS will be generating receipt for my application within a week, and I'll be back from Canada by 8/5. Which means by the time they try to generate the receipt I'll be in the country.
4. We need to provide latest I-94 info in I-485 application and I-94 will not change when we visit Canada for a week.

It was bad that there were no protest when they started rejecting EB3 other workers except the case that AILA expressed some concern. That was made as precedent.
at this point they have not followed so many things in their regulation (act on a revised bulletin, reject EB3-Other-Workers even without the revised bulletin) that I dont know what the regulations are worth anymore...

Hi techskill: I have asked this before in this posting to someone else. Was your medical exam complete in all respect? My wife's was not as she was pregnant then. The Doc didn't administer one shot.
Also to all of us whose files seem to be in the strange NSC Examination room: Yes, the Infopass IO told me that my case is all set. He didn't say if it was deficient in any way. I was just wondering if any of you guys have any such deficiency like medical?
All of us stuck here waiting are getting a prostate exam...and not a gentle one either. maybe thats why we must all be in the examination room.
