I have some.
Incorporating a company can be done even when you are on H-1b and have not applied for a GC. It is a very trivial thing.
But it ends there. You cannot work for that company in any manner - not even write a check. It has to be a 100% passive investment, for example just like you invested in google stock.

Since this is for EAD renewal... nothing much can really go wrong... so Do not worry too much about it.

I don't know what you mean by how secure - it either fits within the law or it doesn't. the only time it would be ambiguous and open to interpretation is only if there was actual verbiage around prohibiting payment/compensation by the employee but that verbiage was ambiguous and open to interpretation.
Again, I perfectly understand and can relate to this notion of "playing it safe" in general. But really, if the law is interpreted correctly, I expect any subsequent actions to be still in accordance with the law. In other words, "safer", "more secure", etc. are nice thoughts but don't lend themselves to researching the original question around what's allowed and what is not or if there is an ambiguity and if so, what is it and how is it open to different interpretations.

Did you get your denial papers, there is a date mentioned in the denial papers, you will have to respond within that date to appeal your case with supporting documents if the case is denied in ERROR (they give reasons in denial letter). If you don't respond the case is denied forever.
Also remember one thing you can't have two PERM applications open for the same company, same position and ofcourse same person. I had to withdraw my appeal to file a new PERM. some people here seem to be lucky to get perm in 2 months but for me it always took around 10 to 11 months. I lost 10 months in appeal and 2 months for withdrawal. so better decide what you would like to do.
Other option, which i am not sure is legal (or valid) would be to appeal the case and when the case status changes to pending file for H1b extension. In the mean time look if some consulting company can file PERM for you externally, if you get that PERM approved you can transfer your H1b... I mean it is easier for us to advice.. and i totally understand what you must be going through.. I was just thinking what options are open.

One does not need to have I-140 receipt number or approval copy as such. But definitely he is required to know the I-140 receipt number and he can show the CRIS approval information as part of the records.

As jetflyer recommends, applicants from the said region should be banned from applying, as they are morally inept to jetflyer's standards. AP folks, please go ahead and withdraw your applications and pack your bags and leave. After that everything will be solved and peachy, with jetflyer flying and roaming in the clouds, jetflyer getting the instant GC (and possibly President would knock on his door and beg on his knees for jetflyer to accept citizenship). If the history has taught us anything, it is that problems can be attributed to a single community or blamed on a single region - we don't need to think maturely, its stone ages for chrissakes.
While we are at it, jetflyer, can you let us know your background? So that we will work towards creating a special category exclusively for you and make sure that nobody else qualifies for it, may be like XB (Xenophobe Based) - only selfish and educated 'illiterate' folks need to apply and its instant GC, no need to wait, just print at home like a boarding pass.

I understand the option of re-entering the country with a new visa, which may be the best way to go. However, there isn't much time left till Oct 31, 2008, and I am wondering if there is any other way to resolve the problem.
1) How does one apply for the extension of the I-94. Which form should be used, and how long does it take?
2) Can one go to the nearest port of entry with the both the current and new H-1B approval notice and request them to extend/give a new I-94 till 2011?
3) What if he goes to say Canada next weekend, and on his return shows both the H-1B approval notices:
Current one: expires on Oct 31, 2008
New one: Nov 1, 2008 - Oct 31, 2011
Will the IO at the POE give him a new I-94 that is valid till 2011?

-Go to CBP and try to convince that you did not show the 797 with validity till Oct 2011 by mistake /error or stress so please correct the I 94.
-Else if the above does not work take a small trip and travel outside and return back before your visa stamp ends(Oct 30 2008) , while at reentry show you visa stamp as well the 1797 with validity till oct 2011 , the POE has to issue you I 94 till oct 2011.
-or else just take an appointment in the home consulate and go for stamping

On the basis of you wife's graduation, you are inviting your wife's parents. So you need to show invitation letter from collage/school (if possible) and sufficient fund in your account...that is all ...be prapare to answer if they ask the reason for their son-in-law sponsoring for their visa instead of their son.
The invitation letter that visitors need (if at all really) are from folks they are visiting, not from the college/school that the student here is graduating from. As pointed out earlier, the reason for visiting can be as simple/generic as "visiting our daughter/son".
The invitation letter is over-rated, but definitely a useful document to include in the folder. More important is the Affidavit of Support (I-134). And that can be signed by their daughter, whether she is on H4 or F1 or any other status, as long as she is here legally (which is your case) and she shows proof of funds to finance her parents' visit here.
There is no real advantage to having their son (on a GC here) sponsoring them, although it might "seem" safer. And since specifics of the reason to visit here (graduation) are not needed, at the end of the day it won't matter who sponsors.

There is no real advantage to having their son (on a GC here) sponsoring them, although it might "seem" safer. And since specifics of the reason to visit here (graduation) are not needed, at the end of the day it won't matter who sponsors.

USCIS is very strict on EB2 criteria so if one doesn't have MS degree ,it is very tough to justify EB2 category even with relevant number of experience. I have seen lot of denials cases for this reason.

It is in discussions and we had discussed this in our meetings with Administration officials last year. There seems to be positive feedback to this. The letter campaign should help make it happen sooner than later.

I think for Eb2 it should be BS + 5 or MS+0 not master + 2.
