If the H-1B is approved w/ COS (change of status) then, come Oct 1st she/he is on H-1B.
Approved H1 does not mean you are in H1.
But if your employer has already enrolled you in his company, then you are in H1.

I got promoted with a hike and then demoted with pay cut. It is all because my attorney was not agreeing with it as per the law. So it not only depends on the company, but also with the attorney you have.
As per the law, you can get promoted to VP or CEO. But once your 485 is adjucated, you have to take up the role for which your LC is filed. I do not know how insane the person is who formed this law, but it is the reality.
Again, if the person stays with the same company where the labor is filed and if 485 is pending for more than 180 days, then there is no problem in promoting this person. This is again as per my attorney. So this entire stupid law messed up my career.
I asked my attorney about this (she is my attorney, not the company's). What she said was that once the labor is filed, most employers are willing to go along with continuing to send USCIS info about the OLD title and position.
Even though the whole employment based green card process is supposed to be for a future position, it is not realistic to assume that a good employee will NOT get promoted in the 3-8 years that the process usually takes. As an example, my cousin, who is in a Wall Street firm, has been promoted 3 times in the past 6 years and is now a vice president. His labor, filed in 2003 for an IT analyst position, is still stuck in the Philly BEC!
What it comes down to is this: you are at the mercy of the company when it comes to promotions.

But in the last 4-5 years I was working on Networking and Systems Administration.
So if I work in this area (Networking and Administration), will there be a conflict.
My resume now has multiple skill set including Java and other programming langages including the AS/400 midrange systems.

I think recording without prior consent is not admissible as evidence. (Which is why I think the customer service numbers at all companies tell you right up front that conversation may be recorded, and give you a choice of not having your conversation recorded.). So if you tell the USCIS customer service personnel that you intend to record the conversation, and if he/she agrees to it, and that consent is also on tape, then would that be OK?
This is a question, rather than a statement, since I do not know. Someone with legal background might be able to shed some light..

This is what my lawyer said. If is for those that filed after Feb 2008 then they will have to wait for years to get their i-140 approved (EB3) or get it aproved almost immediately for EB1/2).

The main post here is not out of context, considering that it is a major opportunity for the Senators to reframe how they think about India.
I recognize that IV is a multinational, multiethnic, multicultural and diverse community. That is well understood and respected, needs no reiteration or reconfirmation.
However, that cannot and should not imply that there is some sort of an uwritten 'ban' on anyone posting a message regarding the perceptions and misconceptions about India, the nation that is most easily and commonly (mis)identified as the nation to blame for ALL woes (high skilled immigration, brownification of the country, outsourcing etc etc etc)
Here's the bottomline reality:
- The green card process is a MESS for everyone
- That said, citizens of India and China are the WORST affected
- Within these countries, EB3's are the WORST affected
Given this hierarchy of problem intensity, it is natural for the worst affected to find ways to get their message out and across in the interest of seeking relief.
MK Gandhi and his philosophies inspired MLK and led to a great revolution in US society. Hence, tagging on that identity, regardless of the fact it is an Indian oriented identity, does NO HARM to the greater cause of legal immigration.
Hundreds of thousands of dollars in lobbying can get you little to no effects. However, a 'small thing' like identifying with MK Gandhi and the larger effects of his BRAND, can lead to an exponential benefit to the legal immigration cause.
So, lets quit getting communal and insular in how we look at ourselves and the world around us. If anyone feels offended and wants to flame me, go ahead. It will be duly ignored, in the spirit of MKG and MLK :)!

I'm all for exempting US degree holders from the quota, though I'm not one. It will definitely make the queue less crowded and make things move faster even for the rest of us.
Thanks for taking the initiative. Also try to meet your Congressmen in person and explain your situation. This is much more effective than sending just a letter.
I just wrote a letter to Massachusetts (where my family live) senators Kerry and Kennedy expressing my experience and frustration caused by the delay of green card -- I am not on AP or EAD even because I missed the July wagon.
I also send the letter to the first lady, fed's chairman Bernanke, House speaker Ms. Pelosi, our friend Senator John Cornyn, Secretary of State Dr. Rice, The letters are all printed and signed, then sent by first class mail.
I didn't post my original text because I don't want the senators receive letters that are exactly the same, that look more like a spam.
Do you want to send letters of your own? Take 30 minutes and that may change your life, I am sure many of the facts listed below are not clear to many senators.
In the letter, I told the senators:
- I graduated from a US university with an advanced degree in engineering. I have been working for several big companies on important products. My achievements include: innovative algorithms for early diagnosis of certain type of cancers (using data mining and other bioinformatics methods), IT products that helps companies follow the Sarbanes-Oxley Act requirements much easier. Currently, I am working for a major health care company as the enterprise architect to streamline the clinical trial process so that shorter new drug development life cycle can be achieved, which may help save many people's life
- I have been in the US for 9 years, obeying every law, paying tax for every penny I earned. Up until now, I have paid $xxxx.xx in mass state tax, $xxxx.xx in Federal tax, $xxxx.xx in Social security.
- I have saved enough money, but can't buy a house right now. Because my H1B is close to its six years' term, I don't want to risk such a big investment with uncertainty in very near future
- My wife has a PhD degree from a US university in cancer research, but her ability of doing research is severely limited, because many government funding grants are only available to green card holders and citizens.
- If you calculate how much were invested to educate me and my wife, the total dollar amount is $250,000.00 (our stipend and tuition paid by colleges added together).
- During the years in the US, we have been educated by US colleges, earned skills and experiences that'd make this country very competitive. We contribute to tax avenue both state and federal level, we help supporting the social security system. We have the money to buy houses, yet we can't because of the uncertainty in future.
- The most important thing is, millions of other law obeying, high skilled immigrants are in similar situation, and are having their lives on hold. Many of us tend to save and are reluctant to spend due to the uncertainty caused by working on temporary visas. Imagine how much buying power will be unleashed if all of us are able to have our green card in a reasonable time period.
What we legal high skilled immigrants want:
- We want a reasonable time frame to get green card. Currently, the waiting time for China is 4 years, India is 6 years, and other countries are also 6 years if they are in EB-3 category
- We want a short term, quick fix for now, instead of a comprehensive change after a year or two years
- We are NOT asking citizenship as many Americans would think, at this stage, we only ask for permanent residence.
What a congressman can do to help us and keep this country's edge as a global leader without a major change in law:
- Increase the quota for green card each year
- Recapture unused green card quota in last ten years
- Waive those who have advanced degrees from US unversities
I do understand not everyone on this board has US degree. So please don't flame me on that. With the current situation, every effort to free even one quota is worth trying. One quota saved is one quota earned.

I applied H1b for my wife when she is in India, now she came to usa on H4, She has I94 of H4 and she cant apply for SSN using H4 194. If she needs to apply for SSN she needs to go back to India / Outside the USA and come back on H1b Stamping where she get I-94 for H1b Status. But instead of doing that now she got her EAD, can she do the any of the below so that the EAD will not come into play and where she can still use her H1b and as you all Using EAD until 485 gets approve is not suggestable....Thank You..

We dont fill the I-140 # in I-485. Employer / attorney attaches the document. If that was the case we wouldnt have to worry much.

I should have atleast one attorney representing me, as my old attorney has not yet revoked their involvement (as far as I know) and my new attorney has already filed G-28 and AC-21 before a month.
The question here was how would we know that the USCIS has my new attorney in their file, but I guess the only option to know this is by getting an appointment (infopass).
Actually, yesterday I called uscis and they told me that your attorney needs to call for that, so not quite sure if I can request my attorney to do so, until we wait for bit more time.

Hey guys,
I'm at the I-140 and I-485 stage now and I'm going to use cross-chargeability to file under my wife's country or birth. I was born in India.
I live in the US and my wife lives in Canada. She will move by the end of this year, but I need to file before May cause that's when my PERM expires.
1. Does my wife need to be physically present in the US at the time of filing?
2. If yes, how long does she need to be in the US for?
3. Does she need to have an H4 visa?
