Hi Folks,
I filed my I-485 application on July18th but my checks are not cleared yet. All my friends who filed on same day with me, before me or even after me got receipt or check encashed.
I am really worried now. I contacted my lawyer, he suggest to wait. Is any one still like me or any suggestion for me.

Here is another point of view....
The thing is we are trying to sale our viewpoint as law abiding, sensible people asking for justice....Now civil disobedience is the tool for the citizens...At the end of the day we have limited rights in this country...
Nobody wants a disorderly conduct misdemeanor on their records...
Almost all of us earn more than 70K an year...Don't expect to get any sympathy from Americans...You are just kidding yourselves..
Last year the illegals marched in the streets, did anything come out of it?? Why do you think they would listen to you now ???

I am not sure if thats correct. Bcos USCIS is trying to generate more money from now on to hire more people. So, Assuming i am goin to renew it every year by paying $375 and assuming u r goin to apply after aug 17th. You will end up paying only $1000 for 5 Years and i end up paying $350 per year for the next 5 years. Basically is a fee hike for people before aug 17th and for people after aug 17th, its not a fee hike, its a downgrade to less fees...AM I RIGHT????
The EAD lasts only 1 year. WHENEVER you renew it (for another year) you HAVE to pay a fee. Hope this helps

How July 2nd @12:45PM Delivered application can get stamped of June 29th on USPS Packing Receipt? Stamped date are changed by s/w. wow.. It's pretty high level of automation at USCIS. if you don't mind please explain how it works. :)

Isnt USCIS supposed to ask for a visa number to Department of State only if they were only about to approve the case or can they really ask for the numbers before hand. Also as reported in the media, I find it extremely hard to believe that USCIS has the manpower to churn 15k cases on a weekend. USCIS is in deep doodoo if it played the numbers game. I am now getting fairly confident that we have a good chance to win this lawsuit.

The rule of 7% is to be implemented annually not over a decade/century.

If you plan to mail the documents, be careful to read the instructions. I just applied my passport to Houston CGI and misread the instructions saying it would take 10 days. It takes 10 days if you got your passport from the local Indian consulate in US but if it was issued by Regional Passport Office in India, it would take six weeks.
They have something similar to Tatkal where you can pay 90 dollars and get it faster. How faster, don't know.
Once you have submitted your application, you are at their mercy and Houston seems to be worse than Indian regional passport offices. Their phones are constantly engaged and they barely respect you when one calls them. You have no way to upgrade.
If you have the time and proximal to an Indian Consulate, I would try going in personally and get the work done.

My lawyer filed my 140 as premium processing on June 21st. [Or that is what they claim now]. The petition was receipted on June 27th which was within the limits they accepted premium processing.
Today, after repeated pestering of my lawyers [USCIS won't discuss 140 with me], they told me that USCIS had refused my 140 premium processing.
They now tell me that they are going to re-file my 140 and ask it to be upgraded to Premium Processing. Apparently USCIS goes by receipt date for premium processing so my lawyer says it will be accepted as premium.
Does this make sense? Or is my lawyer scamming me?
Even when premium processing is availble paying that $1k extra does not guarentee the processing of application for various reasons. By returning $1k they can always say that a particular case can not be accpeted under premium processing. I was reading somewhere that a case under "domestic investigation" I dont know what that means was not accpted for premium processing. I read somewhere on the forum that money is being returned for PP cases that were filed before the deadline.
I am not sure if you can bump it PP just because you filed in regular processing before they suspended the PP.

Basic question which was not present in USCIS Update.
How to make sure that USCIS has updated AC21 information against the case. Knowing this will help to be less worried at port of entry (POE) when using parole. If the new employer information is not updated against the case, then the employment info that is specified to POE officer will be out of sync with the info that is available to him which unnecessarily leads to other questions.
Any suggestions to know if the AC21 info is updated against the case.

If your wife haven't used EAD and still has a valid h4 from your previous employer(provided they did not revoke your h1/h4) she is not out of status.
Transfer her H4 to your new employer ASAP.

I am sure you paid all the expenses +more $$$ to this desi company for them to fake your resume and get over here. And after coming slipping through the cracks you managed in to get some project.
As I have never seen anybody who is genuinely experienced making so many compromises for coming to US. Guys like you are the ones are defaming the whole community.
I always hear a lot of all these people who are working as highly skilled slave, willing to do anything to come here, and I used to think were these people are, I think I finally got one.

Have your kid in US and none of these issues would happen. I would hate to see you suffer the sepration with your family...

I am in a somewhat similar situation (EB2, PD May 06, I140 approved, I485 pending more than 15mths, have EAD but havent used it, still on H1, laid-off, on severance for a few months). Based on my conversations with lawyers my understanding is:
- The 485 application won't be affected even if the employer retracts the 140, this is because it's been more than 180days since the 485 application.
- I can change jobs either through an H1 transfer or using an EAD - lawyer recommended H1 transfer since it gives you something to fall back on (and more time) if a NOID or something is issued on the 485
- If its an H1B transfer try and do it before the last date of employment with previous employer. However in some cases a reasonable gap is acceptable. But if you can't find a company who'll hire you on an H1B transfer, no big deal, you still have your EAD. (Btw, there's some law about moving from H1 to EAD and then back to H1...not sure about that, please do your research on that ....or if somebody else can throw some light on it)
- Technically, you can sit at home and not work. The only catch is that WHEN the 485 gets approved they might ask for an employment verification letter ie. prove that you are currently employed when the 485 is approved. Given your 2006 PD you don't need to worry about 485 approval in the short term.
