I don’t want to start another war here but all I am asking for is a fair treatment of people and not discriminate against people based on country of birth. One of the reasons I left my country, India, is because of the discriminating that exists there in terms of "reservations" where everything is reserved based on your caste for 50%. Now please dont tell me reservations and country cap are different, they are not different they are the same. they accomplish the same purpose in case of skilled immigration.I never thought such a thing would happen in US but it seems worst here because Indians and Chinese make up almost 70 to 80% of H1 (which is dual intent) but when it comes to employment based green cards (which are based on H1) Indians and Chinese combined get only 14% of the visas, don’t you see the tragedy here? Why don’t they enforce the country cap on H1 also, that way people from India and china will not have to suffer worse than others? But US is a competitive country, they want the best available talent for H1 and that’s the reason they don’t put country caps on H1.
Take my case for example, I have come to this country in 1999 on F1 and have been working and paying takes since 2001. I am not even able to apply for 485. If I get laid off now I will have to leave US next year. Contrast this with somebody from Taiwan, UK or some non retrogressed country. In some cases they can get green card within the first year of coming to US. This is not a hypothetical case but a scenario which is happening quite often, especially in EB2. In my own company I have seen people (6 so far) who are 5 years junior to me (i.e joined the company 5 years after I did) get a green card where as I am dazed and confused and haven’t even applied for 485.
I totally agree with country caps in non skilled immigration, because the only criteria is that you don’t have any diseases and don’t have a criminal background. But in skilled immigration it does not make sense to apply country caps unless you apply country caps in H1. but US is a competitive country, they want the best available talent for H1and that’s the reason they don’t put country caps on H1.
getting rid of country caps will hurt ppl from ROW. we need to be united, what do u say? H1B and EB visas are not related and should not be confused as related items. There are exemptions on H1b but none on EB.
totally agree with this.
Have full faith in IV and I am sure they will try to keep the interests of all in mind, not just of those from one country that will benefit from ending country-caps.

You might get your GC while you are at the retirement home....
that seems to be the idea. I meet lot of senior retired people from India ..they say they got their GC's at the age of 60 (through family) ..they get so bored and disappointed that they just go back and give up their GC's ..so yes I agree, think that you are on temporary visa, earn as much as you can and have 1 suitcase packed and ready to leave.

All packets were kept on hold and we should all be ok because they will start sending receipts soon for all complete packages.
The wait will be long but its good that everyone will enjoy EAD benefits .
As such, whats the new fees for EAD and AP?

Given the unemployment rate and also the current market condition, it is not really favorable for starting a Green Card process (Labor/PERM) if you belong to one of the field, where there are adequate number of people already available. The recent economic conditions has flooded the market with many people who might qualify, as the requirement is to accept any US Citizen/Perm Resident, if one has the minimum qualification, even if you do not have all that is requested for. Future GC holder might like this provision after GC !!
In that case, employers should mention the following in the offer letter
" In case, in future, if economy goes bad and recession occurs,we cannot sponsor your green card since it is easy to find american citizens who has minimum qualification."
This should be mentioned on the offer letters given by big comapnies. Then it is up to H1B candidate whenter to take the offer(risk) or not.
Can these companies do this????

Good observation and thats why even though the sample size is small but it may be representative of the community.
going back to the poll. its really interesting to see that the percentages have remained in the ballpark since the poll started.
around 50+% of us will buy a house if ead cap is eliminated or we get gcs
around 35% have already taken the plunge
around 5% will never buy a house.

Ramba excellent analysis. One thing has to be red carefully from the July 2nd memo from USCIS says that all 2007 EB visas has been "allocated" which is diffrent from the word " Approved" and that is the 20K visas as per Ramba.
I completely agree that we should fight to recapture the visas that were lost in last 1 years.

I don't think they're considering the Cantwell amendment. The only amendments being considered are as below. Go to http://www.foxnews.com/story/0,2933,280993,00.html (http://www.foxnews.com/story/0,2933,280993,00.html)for complete article
Proposed Resolution to the Standoff
One of the proposals to overcome the impasse is to offer a limited list of Republican-sought amendments that could be considered before a final vote on the measure.
Bill supporters say, for now, their strategy is to get a list of proposed amendments from the authors of the border security letter Sens. Jim DeMint of South Carolina, Tom Coburn and Jim Inhofe of Oklahoma, Mike Enzi of Wyoming, David Vitter of Louisiana, Jim Bunning of Kentucky, Charles Grassley of Iowa, John Ensign of Nevada and Jeff Sessions of Alabama.
The details of exactly how we get from where we are now to the finish line is not something were prepared to announce today but I do think this bill is about 80 or 85 percent of the way through toward the finish line and we dont have any interest in giving up on it, Senate Minority Leader Mitch McConnell said after meeting with the president.

First we come here which is completely different environment and struggle to adjust, then after 10 yrs or so, if we go back then struggle to adjust in home country.
You don't have to struggle in home country. You were born and raised there and I do not see a need to struggle.
And you are not struggling here also, you have come to pursue your dream, everyone here have jobs, we are just trying to fix a broken system here.

I dont think legally you can sue someone, because they have worked harder.
I posted this link , so that everybody may know the legal reasons, which we can be presented in a court of law.
If this lawsuit is accepted by the court , then the USCIS lawyers would tell what exactly happened.
I till now personally believe , that the USCIS/DOS hasnt broken any law.
They may have however changed a pettern, process , but no law has been broken.
Everybody knows they didn't broke the law, but the way they followed is wrong.
I saw somebody suing her company because her colleagues are using perfumes. If this kind of US, then why should we leave them for this disaster.
What they broke is "They need to give prior notice in advance". They cannot give one-hour or one-min notice. They haven't given one-min notice also. It is outrageous. So, please don't say that they didn't broke any law.
Do you know what does it mean by notice? It should be given well in advance if you want to convey something.
They completely broke all those ethical laws.

Previously, the policy was that all worldwide numbers would fall down into worldwide third and then from there, fall across to the countries impacted by retrogression (i.e. India, China). The policy was recently clarified and today the unused numbers are allocated within the same preference classification.
